Now a days H1 rejections are based on this data. Let’s say an employer filed H1 extension for Software Developer position in Dallas, then they will get RFE asking many Americans have enrolled for software developer position in Texas work force agency site and why you want a foreign employee? 😊 For next 5 years most of the temporary workers will leave with various reasons and then they make Priority dates current. 9th attack to scrutinize i485(already in person interviews under process for issuing GC). 10th attack on N-400 naturalization. It is after 33 weeks which doctors say no. worst case, they can convert to visitor visa till pregnancy is done. Velusamy has two options...one, file an MTR on th existing case, during MTR they cannot work but can stay legally in the country..issue will be with insurance and he needs to somehow continue his current insurance paying out of pocket...second option, get a new h1 filed through some other employer or same employer and stay in country for now...once the new h1 gets approved, it will be approved as consular processing required due to gap in the status...but he will still be in status as they filed another h1...they can even work in this scenario...then he can step out of the country for visa stamping and come back... | ||

R.Velusamy I am in H4 visa, my wife is in H1B visa and working here since January 2016. In July 2017 her company filed for an extension of her visa since her work authorization was expiring on 12/31/2017. On Monday 23 April 2018, she got email from attorney that her visa extension has been denied and her company has asked us to leave immediately since She is out of status now. She is 30 weeks pregnant now and we were being asked to leave immediately the same week. But my wife told her company it is not possible to settle everything out in 4 days and our flight tickets are booked for 05/02/2018. Now is there any possibility that we can approach the local congressman/senators office and they would look in to my case or any other possibilities. |
