my suggestion for that guy is it is a just a job, nothing is lost.
He is far better situation than guys who lost their families and kids due to various reasons. He has his family with him, he just needs to go to another country and start a new life. There are somany countries in this world. He can come back to us after 15 years if he wants to.

In my personal experience how laptops being exchanged, tech support guys will ask what info you needed from the old laptop and will take backup on those folders and restored back to your new laptop, this could be done in different ways, sometimes they might copy your personal folders to shared drive/network drive for temporary holding of data.

When a company decides to terminate an employee, his account will be locked minutes before he is let go. In this case, I am surprised how this person was able to copy his personal data after he was informed about his termination. They will be just walked out with out even allowing to touch any equipment, especially computers. Personal belongings like pic frames, books etc pack chesukovadaaniki boxes provide chestharu, anthe.




This is not a layoff, from what I understood fom Valasa's post his friend is already under performance improvement plan (PIP)...in this case, the candidate knows that they are going to fire him in the next 2 months, so he was getting ready to back up his data

Agreed! A very careless mistake and it’s bad timing. He kept on kicking himself and is undergoing mental trauma. Except for worrying for his family, we are helpless.
It was scary when he mentioned why living seems to be useless. His attorneys words were ringing in my ears, first time offenders will have suicidal thoughts. Except for showing the brighter side of life and giving mental strength and offering monetary support I couldn’t do much.

My lessons- be mindful and focus on what we do. I am trying to stop multi tasking for little things like no more talking on phone while driving( car blue tooth of course) and can see how sub conscious stress is reduced. When we focus on one thing we tend to do less mistakes.

if email to non company domains are blocked, other option is.. if your team uses cloud based apps like JIRA/RALLY, edo oka story create chesi aa story ki attach cheyandi the docs you want to send out. Intiki vachaka download chesi aa story delete cheyandi.

Just to be clear, I'm not mentioning loop holes for illegally procuring confidential information. Enta jagratta ga undam anukunna edo oka vidham ga dorukutam chetta panulu cheste.. dont risk entire life and career for little gains.

My close relative got terminated for somewhat close case. Project maare time lo personal data backup chesukunnaru from lappy to usb. Then the security found something when he surrended the asset and on these charges, he was terminated. Apudu memu chala badha paddam, oka trivial thing ki job poyindi ani.

Ee thread chusthe inka bhayamkaram ga undi! The company would have filed the case as the data transferred could have been very important or the security department has no pani bongu.

no. because - he just plugged in. immediately manager called security ppl. they kept the drive and verified everything. found nothing but personal data.

They walked him out immediately and returned the drive almost after a month or so after verifying that there is no company data on it.

It takes about 8 months from the day the company files charges and court date etc .. the lawyer can further delay it by counter filing a suit and asking for extention to prepare defense .. means company is spending any where between 200 k to 500 k on this case .. if the lawyer files a counter suite the company might end up spending million dollars .. plus public reputation bokka ..

Considering all this I conclude his friends name is Sudhakar and worked for Equifax

what we have to understand is that HR laws are there for a century......all scenarios are almost covered about wrongful termination for decades and if its a temporary consultant.....its even easier....

so a company will not bend backwards to reason a termination at this day and age.....unless its a racial case.....or something serious like that

not really.

it happened to one of my friend also. much smaller.

He was working in a bank. He just attached hard drive. not even copied anything. Manager saw this and complained and walked him out the door. (he was working there for over 10 years by that time)

sad....but even if i beleive its unintentional...it was careless, that said....i would be careles too...

for me the point is that, the company pursued this to avoid any backlash given the sensitivity of the data.......they simply covered their back...If tomorrow....someone puts a case on them about a leaked info from somewhere else but theirs.....

there may be data with us which we dont intend to use for any gains....but that very info is very very sensitive for others.....adhey grounds Jury koooda alochisthaaru anukuntunna.....


I also think....Jury doesnt need to know how IT works.....in all fairness.....

It happens in life.....everything that happens is for good....

If a person is really talented enough he would get job easily in another country and rise from ashes fast....

Mistakes do happen...my case is an example...trusted person cheated me and I restarted my life elsewhere...charged by police.... listed in federal criminal record .....result is I may not be hired in the country...this charge remains in my record for 3 years....

Just moved to neighboring country and started fresh....happily living.....

Moving ROI is always an option....no one cares ...you can start your own company and live happily....that’s the last but good profiting option.

The termination reason, "he did not fit into his role", data breach discovery happened after he submitted his laptop and was screened by the security team and they notified HR and Hr called him and returned the data stick and things progressed from there.

That's why Attorney says, it's framed for two reasons. To save money and burden of data breach and to protect themselves from wrongful termination. I even see some racial angle too.

Another thing learnt, here you can only appeal after sentencing and if only there is a mistake in proceedings. Indialo laaga city court, high court supreme court ala poothu vundavu anta.

Okasaari sentencing aithe.....immediatega court nunchi direct prison ki teesuku pootharu anta, tarvaatha ne bail or appeal only if you qualify. Appeal can only be done when you can prove proceeding problems. Not every case can appeal. Appeals function both as a process for error correction as well as a process of clarifying and interpreting law and you are allowed only to appeal once.

I learnt a lot, usually we don't see these kind of incidents happening to our near and dear and are blissfully not aware of the process or consequences.

It's better to know and learn. I didn't know what Felony, misdemeanor and infraction were. I didn't knew legal terms like infringement when the defense was using those words. They went on top of my head.

Internet crime and Computer fraud is very loosely defined law and it's our duty to learn about it and teach our kids on how to conduct themselves and what a small fight in college can lead to.

I personally learnt a lot from this and will teach my kids that it's better to shut up. Co-worker was explaining how his kid was saved by not choosing to say anything, when their group was caught possessing illegal drugs.

What's worse is, this guy or for that matter even I never took this whole thing could flip like this. The lawyer and everyone assured it was a very trivial case and they don't have any proofs and he will come out clean. It's beyond comprehension. He was so strong up till the jury's decision, because he knew he did not commit a crime.

I sat in one of the proceedings to give him moral support and witnessed myself. A lot to learn on how law and judgement works. We need to teach our children, about our rights.

When the HR asked for a statement, he went on record and admitted that, "he took the data unknowingly". Both the lawyer and his white colleagues immediately slammed and said, you should not say anything using your 5th amendment.

Notice the culture difference, we think that speaking truth will help us than saying I don't want to talk. In our culture we are trained to think that not speaking will reflect hiding truth with malicious intent.

I personally learnt a lot from this and will teach my kids that it's better to shut up. Co-worker was explaining how his kid was saved by not choosing to say anything, when their group was caught possessing illegal drugs.

sorry to say...either he is brainlet or some pieces missing in his info... if he is few weeks in to company , usually there wont be nothing to back up as such. also you saying he is two decade exp with usc, then there is no way from day 1 he had trouble with his team... i will try to give benifit of doubt to him, hope he come out clean if no bad intent in his action

They are saying he intently took out the information. It's my word against your word allegation and the decision is left to jurors. I went to the proceedings, it's scary to watch how one's life is hanging between opening statement, IT forensic report, closing statement and jurors discretion.

I will give some jurors professions to give an idea, realtor, warehouse manager, plumber, small business owner and so on. To them all that they can see is he took the backup of file, which he should not have according to law. They didn't understand default folder download concept for both resume and reporting website url. What's more strange is both realtor and small business owner mentioned that it's their peak season and they should be relieved during the selection, but still selected. They get paid $40 per day it seems.

What's worse is, this guy or for that matter even I never took this whole thing could flip like this. The lawyer and everyone assured it was a very trivial case and they don't have any proofs and he will come out clean. It's beyond comprehension. He was so strong up till the jury's decision, because he knew he did not commit a crime.

The federal computer fraud law that most directly relates to internet crime is the Computer Fraud and Abuse Act (CFAA), (18 U.S.C. 1030). The CFAA is a cybersecurity law which makes it a crime to steal information from or damage a protected computer system.

This law criminalizes various different types of harmful internet activity, such as:

Intentionally accessing a government computer without prior authorization and changing how the government operates the computer;

Knowingly accessing a "protected" computer with the intention to commit fraud and procuring something of value;

Knowingly accessing a computer with no prior authorization for the purpose of procuring national security data, financial records of a financial institution, or information about a U.S. department or agency;

If you notice, no where here it says they need to sell. They can simply charge that you have taken it with malice intent. They skipped the burden of proof by saying that they caught him quick.

Which is a joke, as his lawyer repeatedly proved and made even their experts agree that there are better ways to do this. At the end of the day, the judgement in this country lies in jurors hands.

Jury initially came out as hung jury, the Judge forced them to come to decision and they wanted to close it quick and decided as guilty.

Being immigrants and not knowing law and terms and the whole process will bite us. Better to know, how law and judgement works in this country.

There was no motive to show that he intended to commit any form of crime using that data. An honest mistake can be costly but it shouldn't be 12 years. There are no financial gains. He voluntarily submitted the USB drive back(he should not have). Overzealous attorneys.

Every company is different, one of my friend worked for the client 10 years later his contract was ended he copied some of his personal files from the company laptop and it was noticed by the company security, they called and questioned him for 2 hours and let him go.

Unfortunately, the burden of proof showing you misused the date or tried to sell it is not required to declare someone guilty according to IT crime. The IT commission defended saying that they caught the security slip before it had a chance to be exploited. Unlawful taking and holding information is enough to charge and convict.

I am getting my own doubts, I see one company who copied the code from state project and try to implement in another state were caught, and finally, they came out free. I see one case who involved in kickbacks and came out free. Compare to those cases this one is nothing.

Someone very close to me is going through a crisis and I don’t know how to help or advice, venting through here and also cautioning everyone to never ever deal with sensitive data casually. A small act of carelessness will ruin your life and effect the entire family and friends.

He started seeing this attitude’s ripple effect within 2 weeks from his boss who hired him as well. Things were going downhill very fast and he was put under suggestive plans and team stopped coming to his meetings. He quickly understood that he will be let go and started preparing his resumes and work to the point of request.
During his first month, he fulfilled many requests and one was an email to generate a report for HR department. He ran the query and generated the report and sent it to them. Fast forward another month, he was notified by HR that he was let go. He quickly took a backup of his personal folder where he had his resumes, cover letters and some technical white papers and left. Although he was anticipating this move, he was totally devastated.
After a week, he got a call from his HR that he has some company’s information and need to return it, He didn’t understand and asked for clarification. She said that he took a back up in a memory stick. He immediately searched for it and drove to the HR and submitted.
What he didn’t realize is that he accidentally backed up that HR data, that reporting tool downloaded the data in the default download folder. When he hurriedly took back up of the folder.
He was charged and he fought the case, showcased how it was a pure mistake with no intent and none of the information was never opened (based on IT forensic report of open timestamps). Also, the security head and defense agreed that human errors can happen, and the tool downloads the data by default and their security model is very loose. All the jurors were presented with this information and none of them understood anything about IT and only stuck to the point that he took the information and found him guilty.
The entire family is broken down to pieces and devastated beyond words, this is a felony Category C and could be sentenced for a prison time and will be in his record for 12 years. His life is ruined, will never be able to work in any job or get a loan and cannot go back to normal. He is numbed and unable to digest what happened. He has small kids and wife is in a shock mode. Being very close, I can't imagine their pain.
