But USCIS (which comes under DHS) forced DoS to revert this bulletin. I rambled away last night but this is what I essentially mean. If there is a significant lobbying effort, people impacted and people sympathetic to the issue will join. I have been with these kind of efforts for few year during formative years . But they mostly fisseled out everytime some corrective measures taken and problem alleviated. Couple of them started strong(isn.org) . I couldn't find them anymore or may be they transformed to something else. The numbers of this community is too small. Impact is smaller. As the numbers increase you will see up in the effort. If I or people like me see this issue on the radar we will definitely support it as we have lived through. No matter which party is in power, this issue will not be on the top of list. The most aggressive promise I have seen anyone make in this area was Obama and based on the email that did not result in any action I do agree that the work visa issues doesn't get enough attention in immigration reform. | ||

you put me into guilt trap . I don't have any argument here is my honest answers to few issues you listed.. We are not doing much to alleviate this pain for fellow desis. I remember being on some immigration email lists, participated in some letters to senators campaign 3 to 4 years after I got my green card but slowly dropped out of That. There is no consistent lobbying effort and my priorities started to change as well . The uscis is one of the poorly, in fact worst, run organizations in US. They are understaffed and unaccountable . Since the number of people impacted due to this is small, this never gets attention . Also this affects only Indian and Chinese. Unless there is a strong lobby, this issue will not be addressed Historically, we have seen uscis take measures to clear these backlogs . So I don't think your assessment of 10 yrs for your Gc may be right . What is the maximum you have seen someone wait on green card?? H1b and greencard are two different topics. Earlier if you don't get 140 Approved within in 6 yrs of h1 validity, you had to leave the country and apply consular. But now rules are changed where you cans extend the visa. So that is good change .. Right ? Comming to politics of this, it's all in numbers . Illegal immigration is affecting 15 million people and the problem you are mentioning has smaller number impacted. So you don't see any discussion at that level. I am not trivializing your(our) pain but I putting it in perspective. Post 2008 Recession, h1b has come under severe fire. The cases of h1b abuses hit mainstream . So you see more scrutiny. I don't think it has anything to do with party. I remember Obama recapture of visas, I have not followed up on how it was implemented because I never believed he would be able to do that. Comprehensive reform includes path to citizenship for legal immigrants also. The details are not clear i have known people who applied in 2001 and 2006 that got green card in 2008. This is what uscis used to do to clear. Bottomline, unless there is a strong lobby pushing this issue, this will not get addressed and it will not be on presidents priority list. They have several other things to take care before they hit this. Sadly, that is fact. Also, if uscis performs their job well most of this problem will go away. Thanks annai. At the outset - let me state...It is appropriate for me to post this in this thread. Because I hope this is not just some "scold HRC or elevate HRC" thread, but can also be a policy discussion related thread. And then it starts... First things first. I'm in EB2 queue with 2011 priority date. I've no hopes of getting my EAD, in the next 5-7 years. And my GC, I have no hopes of getting it in the next 10-15 years. A friend (let's call him frn) of mine is in the country for 8 years now - still stuck in H1B status. Because of this - just early this month.... frn landed in an opportunity which would have paid close to $60K more per annum had frn had EAD or GC. This is a HUUUGE deal for someone like my frn - a middle class person. Who is the loser here? Is it just frn? Definitely Not. It is frn and some qualified American who could have made more money. frn had no choice but to work at this wage. It is obviously above the minimum wage, DoL wages in Labor, etc. It is all legal. But still, end of the day, Citizens/PRs are also big losers in this game. Because, this will drag the wages down. The trickling effect is disastrous. So, what is happening here? Just because frn is stuck in a GC queue - This injust is happening to both frn and qualified locals. Who on earth measures merit by country of birth? For Family based GCs, I agree. But for Employment based GCs too? Why can't anyone in Desis, with voting rights, even seem to question this premise? Coming to H1Bs Was anyone sane made the rule that H4 can't work? What era are we living in? Does it mean people (be it male or female) who arrives in USA on H4 visa, loses the right to work? They are less important all of a sudden? For this - as an ointment (not the ideal solution, but at least better than nothing) - There was a rule made during O's term to issue "certain" H4s EADs. Those "certain" have to be spouses of H1B holders who got their H1B status extension based off an approved I-140. But filing GC - doesn't start soon for anyone - some people may be lucky. I don't deny that. But how many H4s would qualify for that within the first 4-5 years of their arrival in USA? (There are other options like - H1B/H4 couples spending a lot of money, time in getting into F1 in some "university" - and then OPT/CPT - again H1B - why should it be so circuitous for H4s? When that's not the case for L2, even F2? Are they not equal human beings in front of the law? The society?) By the way - this partial fix for "H4s being treated as second grade citizens" problem -- is about to be undone by O (it is not yet set in stone...but it is definitely likely - more details below) That's just the crux of the problem. Now coming to the achievements of the current pesi so far (we should give some credit to HRC also - as she was Sec of St): 1. Promise Immi reform in the 1st year of his presidency without fail - gets both House & Senate. Squanders it on some trivial things. Starts making childish excuses about CIR ever since. 2. He promised to recapture 500K wasted GCs over the last 10-15 years - that were wasted due to incompetency or un-implementable policies of USCIS. That would clear all the current GC backlogs. Gives a fresh shot to the president to set a clear policy for documented immigrants - so that these injustices won't happen at least for the foreseeable future. But what did he do? "Almost" ignored them. And actually did nothing. This doesn't seem to concern Desis supporting O/HRC/Dems. Please question them. 3. These two are extremely important for Legal Immigrants -- because there are close to 300K to 500K people stuck in GC backlogs. But all day, every day, all we hear is O whining about "Path to Citizenship" of "Illegal" immigrants. But neither O, nor HRC doesn't even mention these issues. 4. O/HRC introduced some extremely stringent measures for H1B -- at both petition level (authority: USCIS) and also VISA issuing level (Dept of State) -- they need each employer to establish "employee-employer" relationship. They need a client letter mandatory. Increased the H1B and L1 filing fees - on the pretext of spending this money for border strengthening with Mexico. -------- the first couple of points look "politically correct". But the devil is in the details. Not many people stuck in GC backlogs are still on H1B by their choice. But by compulsion of circumstances. So, without clearing the backlogs - what's the point in putting all these restrictions? Who are the losers? As I gave the example above, it's not just immigrants, but also locals. 4. Then started the USCIS amendaments story -- earlier - people used to file an H1B with 2 places(states) as possible work locations. Now, if you change your client, your employer, your work location by a certain distance - you've to file an H1B amendament. And when you file the amendament or extension you are allowed to "request" for a 3 year validity period. But you are at the mercy of USCIS for this. I heard a lot of stories first hand where they got very small term sometimes as short as a couple of months. These amendaments are not easy on the pocket either. They cost hell a lot of money - be it in the USCIS fees or Attorney Fees. Eventhough on paper the employer pays for these expenses -- it'll certainly hamper the H1B worker's earnings. 5. In 2012 June - O signed an executive order to issue work permits to close to 1 million Illegal Immigrants - I think DACA he called them. Whatever name he may give them, it doesn't matter - if he is not extending this freedom to those people who actually are here legally. Is that fair on any count? Did any Desi question this? 7. And last year the H1B/L1 fees were doubled again. Now, an H1B will potentially pay close to $8K in only USCIS fees - not including Attorney Fees, DoL fees, etc. etc. 8...many more...can't seem to recollect them all... one final thing before I jump to the mother of all "cheat exercises" of O's term 9. Almost starting at the same time as the fee increase -- in the last 1 year or so - the H1B extension processing times have been taking as long as 8-9 months. This from an agency, USCIS, who boasts that we don't run on govt money, but we run on revenues. They never even answer the questions as to why they can't hire more people (after all they run on fees paid by immigrants) to offset the workload. Nope, they don't answer. They're busy working for DACA/DAPA EADs and what not. Did any Desi voter question this? Nope... O's 2014 Executive Action: In Nov 2014 - O announced Executive Action in Vegas - a huge stage was set. He spoke for 30 minutes - his speech, histrionics, and the drama that unfolded afterwards -- never did he utter even a single word about legal immigrants. But spoke only about Illegals. As if they are the only ones with issues. So, when Whitehouse published the Executive Order on wh website a day or two later -- legal immigrants were elated to find that "Wow, finally someone in Washington, that too none other than the POTUS heard our concerns. Not just that, he actually ordered his administration to address these issues". This hope lasted long - but as always O showed where his priorities lie...important details below: 1. DACAs (Deferred Action against Childhood Arrivals) - will get work permits and a legal status immediately. Deportations will be stopped. 2. DAPAs (Deferred Action against Parents of Americans) - will get work permits and a legal status immediately. Deportations will be stopped. 3. Legal Immigrants with approved Immigrant petition (I-140's actual name) - O says "Issue Portable work authorizations, easy job mobility, etc" to thes pepole. This is nothing but, in layman terms, EAD/AP for I-140 approved people. But here, nothing is immediate. O asks USCIS to provide a report within 120 days - and then come up with an action plan - and then start working on that action plan - and at the end of that whole process, start implementing it to benefit the Legals stuck in backlogs. In the same EO, O also ordered Department of State to make sure that all the VISA numbers are utilized without fail each Fiscal Year. I don't know why they have such special treatment for Legals - while Illegals get EADs immediately as per EO. What happened next? DACA/DAPA - were put on hold by some court in Texas. Then O, O administration, DoJ, and many big shots in the "liberal" party fought tooth and nail in Texas, and then in SCOTUS for over 1.5 years - allocating tons of resources, at the level of AG itself. It is all commendable (as it means follow-up of one's own words), if only the following didn't happen. Legal Immigrants - Let's take it in 2 parts. Legal Immigrants - Department of State/USCIS fiasco When Oct, 2015 visa bulletin was released by DoS on Sep 09, 2015 -- there was a unique idea to address Legal Immigrant's concerns. The DoS introduced 2 kinds of dates in the visa bulletin for people waiting in GC backlogs. 1. I-485 final action date (new name for the already existing cut-off date) 2. I-485 filing date (new) - with this, one can file I-485 even though his/her priority date is not meeting the Final Action cut-off date. This filing date was set at Jun 01, 2011. The Priority date for EB2 already moved to May 01, 2010 back in 2012. So this was mostly for people who had Priority Dates between May 2010 and Jun 2012. This would have granted EADs, APs to at least 100K people (primary GC applicants + dependents put together). This bulletin was supposed to take effect from 1st Oct, 2015. A lot of people changed their travel plans. A lot of people took medical tests. A lot of people stopped accepting offers that are active. Just to make sure that they file 485 - and then at least not be tied to "a single" employer. But what happened was -- on Sep 25, 2015. USCIS & DoS pushed blame on each other, but in the end screwed up all the 100K+ people that were supposed to get benifitted. By retrogressing the "filing date" to June 01, 2009. Making the "filing date" useless. Close to 99-99.5% of people with priority dates before June 01, 2009 - have already filed their I-485. So who did it benefit? Nobody knows. Did O utter a word? Did his administration utter a word? Nope. Contract this with the way they fought for DACA/DAPA. Legal Immigrants - USCIS fiasco USCIS submitted report around 8 months later (as against 120 days). Then their action plan came another few weeks later. Then they started working on rule making. USCIS initially put Oct/2015 as the tentative date for the draft version of this rule (I-140 EAD/AP - as then was popularly known) to be published. But it got published towards the end of Dec, 2015. Everyone eagerly started reading the draft - that has 186 pages. People were reading, reading, and read some more. But there was not even a single provision of O's executive action there. There was very weak and hardly ever can be used provision that says "If you've an approved I140 and if you can prove compelling cirsumstances - USCIS, which doesn't want to define those compelling circumstances in this rule but wants to keep it to our own discretion - you'll be granted an EAD. But that EAD can't be extended - unless your Priority Date is going to be current in the next 1 year. When PD becomes current for such beneficiaries, you can't apply I-485 or change of status. You've to go for consular processing in your home country" -- where is the response from O on this? It is a full 8 months.... This rule from USCIS also proposes this -- right now there is a time commitment of 90 days for approving EADs. We propose to do away with this time restriction. ---------- what will this do? This will introduce tons of more uncertainity for an H4 who is working. The H4 can work on EAD. But when the EAD expires -- USCIS doesn't want to issue an extension or interim EAD...If the EAD approval comes through before expiration, all good. But what if it doesn't? Please read about the plight of H1Bs above in terms of processing delays. That H4 effectively loses job. -- so is this not undoing the one good thing that O did, even though half heartedly and partially? (H4 EAD rule -- with the conditions I mentioned earlier in this post was implemented effective May 26, 2015). Now, after this draft rule - even though O or his administration didn't comment -- people stuck in backlogs reached out to their local congressmen, senators, etc etc etc -- but even after that, O didn't comment, let alone allocate AG to defend it Did any Dem supporting Desi with voting rights question this? After this draft was published -- there was a public comments period. Everyone submitted their comments. It's a full 5 months since that comment period ended. So far, USCIS is mum about when they'll publish the final version of the rule -- god knows if there are going to be any changes from the draft version. But USCIS doesn't want to commit to issuing the final rule -- nor is O pressing them. ika HRC vishayaaniki vaste -- in May, she publicized that she was going to answer top questions on quora.com on a certain date and time. So, people started posting questions - all kinds of people with all kinds of issues. Naturally, all GC backlogged slaves - posted their own questions. There were 2 (or was it 3?) questions in the top 10 (in terms of voting up of the questions on quora.com) related to our plight.....HRC conveniently ignored everyone of those questions. Didn't mention them, didn't answer them. Nothing. But just 2/3 days later - she participates in a rally to support illegal immigrants. Proudly presents some illegal immigrants on the stage of her rally.... As recent as a week or two ago -- she categorically said (in a video interview - so there is no scope for misunderstanding) that for her CIR is about "path to citizenship" - everything else is a distant second. She didn't even mention the plight of the legal slaves. Why? I can't think she doesn't know about our issues. After all the whole EO was about that. Even though O didn't follow-through....the EO was a very good one in terms of granting some freedom to legal immigrants. But is any Desi questioning DNC or HRC or O about these? Nope. Nada. Zilch. It is an extremely lengthy post....sorry about the length. But All these conteents are true to the best of my knowledge. I have seen the Gc queue clogged and. Cleared off 3 times.. 1999 2008 and some other time. By cleared off I mean every one was made current. That is how my 140 was cleared (1999). That is not the entire issue but that is the main issue. There is a larger number of people affected by it. Frankly, other than the fact that DNC generally support H1b visas, I don't know much. I go with tatha, just accept it and let the revolution continue...he forced a lot of change..I will take it.
