She has to leave country. Come back on H4 (if she has that option). Mean while your company can file H1. If approved, she will get it without I-94. Need to go out of country and get stamping done again. But ippudunna situation lo not easy to get H1. | ||

This is NOT TRUE. After being illegal in US, then leaving the country, when such person re-enters the US and officers allow her to enter back at POE, at that point, all previous illegal stay issues are ZEROED out. Just leaving country with illegal record doesnt wipe the illegal stay records off. The next allowed re entry only. In fact if you leave country with the illegal record, it would bite you when you apply for another visa (in or outside the US) or on your next entry :-) be careful in the interpretation in the REAL WORD to WORD. | ||

from my trackitt experience in observing threads there, this is what she can do. 1. she is out of status now as her i94 expired. so she needs to step out of the country now. stay of one month on expired i94 is valid since she is covered under 240 days rule. Since she already got decision on h1 petition, she needs to leave now and 240 days rule does't cover anymore. Even if her employer opens MTR on that petition, she can't guarantee her petition will be accepted and that she will accumulate illegal stay from this waiting period on MTR decision. 2. Meanwhile you can hire her FTE with new h1 petition wiht consular process. but before filing her petition study her previous decision document. why it was rejected and what documents needed etc. your lawyer can do this carefully. 3. she can continue to work for your company from india if she is interested. you can run her pay as a independent service provider with flat 30% TDS cut in india rupees. consult auditor/cpa in india for this. he will tell you this process for small fee. 4. she is lucky to have your support in this tough times. | ||

My contractor got her extension denied today, her 140 was expired a month back. I don't want to lose her as she is really good, what are my options? can i file for her h1 from my company now? or do i have to wait until April to file her as a H1? |
