His i-94 expiration date was entered incorrectly by CBP... officer mistake... my friend didnt realize it until few months after expiration date... he was out of status for few months.... he then approached Murthy firm and after few months back and forth CBP agreed it was their mistake and corrected his history... Plus ikkada istunnav suggestions... no body knows (ever attorney in some cases) how to handle situations like these.. so past experience meeda suggestions istaaru andharu... neeku comedy anipinchocchu, tappuledu..  | ||

Date correction ante new extension/ i-94 date ki request cheyyamani kaadu.... This isnt a travel visa where the applicant leaves the country after 6 months automatically regardless of the outcome... ikkada candidate has valid visa and staying in US legally... ippudu sudden ga back dated expiration date icchi he is out of status ante dobbalem kada... There is no rule saying candidate has to leave the country 6 months after filing for the amendment application (when he still has valid visa).. its not the applicant's fault here.. he cannot predict that visa expiration date will be in the past.. ide point attorney request chestaad emo ani antunna... | ||

Mana DBer mahesh_fan also got approval with end date in the past... In his case the end date was with in a week he received the approval.. He attorney filed for renewal and he was ok.. he technically had 1 week gap I think.. he can confirm OT Anna ... He can definitely follow what you suggested but I think attorney can file a case for date correction.. let attorney decide should he be in US while filling or out of US | ||

Attorney can talk to USCIS . Emc2 is correct - apply for date correction I once had a similar issue related to typo(not validity date) in the approved 797. Not sure what the attorney did but he got it corrected in 2/weeks. | ||

REACH OUT TO THE ATTORNEY IMMEDIATELY. Alternatively (confirm with an attorney), if this person has visa stamping that is valid till original expiration date, he/she has to travel outside the country and come back in with the same passport. Then they get new expiration date at Port of entry. | ||

H1 applied May 2016 , approved H1 Valid till May 2019 End Client changed in May 2017 , Amendment applied on May 2017 Amendment approved on July 7th 2018 , with valid till date June 20 2018 last sentence you read it correct - No Typos Now candidate is clearly out of status under â Most recent approval overrides rest everything â clause IMO : 10 days or 60 days grace periods doesnt apply to him as he wasnt â deniedâ Now what r his options ? spouse holds H1 seperately , so can he apply H4 COS staying in USa ? better exit country and come back on h4 visa is my advice anything else ? |
