If an individual does NTA, then the individual cannot enter back into the country for the next 3 to 10 years. (Not sure about the how long the period is) In my friend's case, he got for 10 years, it all depends on Judge discrimination(my guess). In no NTA is done, individual can enter back in a year or next month if the individual gets another visa in another category. Don't sweat a lot, make sure your application is accordingly, take time to review, make sure titles of your previous employers and job descriptions and LCA are perfect. Recently I saw an LCA was filed for .net and job description for Java, when enquired about it then HR realized the mistake. | ||

All these new rules are fine prints in the application, earlier they were not implemented as strictly/seriously. New rules are coming for OPT. In 2005/2004 I knew one of my friends got impacted due to NTA, Judge said why did they stop my friend when is leaving the country and at time INS said its the law. Later USCIS made a decision not to do NTA since it adds extra effort and resources to the process. Coming to rejections without RFE is kind of an existing law, stating that the application should be for an individual and individual's job requirement.
