Here is the email from my attorney 2 weeks ago.be prepared for the worst is the summary. Here is what we know: The H-4 EAD has been in the news a lot recently. A pending lawsuit was brought by a group called Save Jobs USA and that lawsuit was stalled in the court system because the courts found that the group does not have standing to sue. They took an appeal and that appeal is pending. In November of 2017, the court denied a request to extend deadline and said that the parties must file their motion by January 2nd, 2018. Meanwhile, DHS has published an agenda item in the federal register for removing the H-4 EAD from the regulations based on the Buy American, Hire American executive order. Regardless of the outcome, the government has moved forward with getting rid of the H-4 EAD. For that to occur, the government must first go through a 60-day notice and comment period and a 30-day period to reconcile those comments. They will then publish the final rule with an effective date in the federal register. As you can see, this will take a few months. As far as how the EADs will be treated – they have not indicated how these will be treated, but if we draw from how they handled the DACA cases, they will most likely say that all approved and pending EADs will be honored, but they will accept no new applications. This is not a guarantee it will happen this way, but an educated guess based on their previous actions. As we know more, we will share that news, but as of now, this is all we know. " " | ||
