House Passed H.R. 5982 "Midnight Rules" Relief Act of 2016

As we reported yesterday, the House passed this legislation. The Section 2 of the bill will amend the Congressional Review Act (CRA) to allow Congress to consider a joint resolution to disapprove multiple regulations that federal agencies have submitted for congressional review within the last 60 legislative days of a session of Congress during the final year of a President's term. Congress may disapprove a group of such regulations together (i.e., "en bloc") instead of the current procedure of considering only one regulation at a time. This bill now moves to the Senate for its action.
However, as reported yesterday, President Obama had already declared that he would veto this bill. This bill will thus have to overcome two hurdles: Senate must pass it, but the Senate may not have 60 votes to overcome filibuster. Secondly, even if the Senate passes it, President Obama will veto this bill and current Congress (114th) does not have enough votes to override the President's veto

FTE companies are usually not one person driven at the top...more transparency and stability

A: They removed the restriction of twice in a lifetime. Now it can be used one time during each validity period.

Now PD could be retained, and 140 can also be retained...so you can get unlimited h1b extensions...even if your new employer is slow to start your GC process or does not want to start your GC process

In terms of legal requirements, nothing has changed. However, the new supplement form must now be signed by both the employer and employee. The employer must also agree to certain legal requirements such as release of relevant company records, audits, on-site compliance visits, etc.
To a certain extent, the new supplement could potentially make portability more difficult than before.

1/17/2016: Obama Tells Agencies to Continue Issuing 'Midnight' Regulations!

Surprise and surprise. Lately, the rule-making activities of the OMB/OIRA of the White House have been frozen, apparently at the demand of DT transition team and pursuant to the tradition in the past, pending the transition of the Presidency. Reportedly, the House is about to pass a legislation to mandate the Obama Administration to seize all the rule-making activities pending the transition of the government. Reportedly, President Obama alerted that he would veto such legislation. The President Obama rather ordered to continue issuing midnight regulations and not to stop the rule-making activities until January 20, 2017 when he leaves the White House.
There are a number of rules the Obama Administration have been working on, hoping to complete them. Obviously these should include the Obama Executive Immigration Action programs. What an interesting development! Stay tuned to this website for the development of this confrontation on rule-making power between the current government and the in-coming government.

Final Action Date is 1 year or less (without having to show compelling circumstances).
See final 8 CFR 204.5(p)(3)(i). The final rule allows family members of these
individuals to also apply for employment authorization, and provides that the validity
period for their EADs may not extend beyond that authorized for the principal
beneficiary. See final 8 CFR 204.5(p)(2) and (p)(3)(ii). The large majority of these
individuals, after availing themselves of this temporary relief, are likely to continue on
their path to permanent residence.
DHS is finalizing the compelling circumstances employment authorization
provision with several changes to the proposed regulatory text to clarify the eligibility
requirements for initial and renewal applications filed by principals and dependents. An
individual requesting an EAD must file an application on Form I-765 with USCIS in
accordance with the form instructions. Under final 8 CFR 204.5(p)(3), some individuals
may be eligible for a renewal of their compelling circumstances EAD on either or both
bases of eligibility, depending on their circumstances. DHS also recognizes that an
applicant may seek to renew his or her compelling circumstances EAD on a different
basis than that on the initial application. In the responses to comments below, DHS
further explains the provisions in the final rule, including the manner in which DHS
determined the specific population of beneficiaries who would be eligible for this type of
employment authorization and its rationale for providing employment authorization only
to those individuals who are facing compelling circumstances.
