The moment he agreed to be a mediator - he has assumed the total responsibility of getting money from both parties and communicating every detail. THE BET WENT ON the moment Pulp sent the last email and MM did not contradict! Regarding collection of funds from Lolligaadu- it was MM's responsibility! He should have mentioned in written form that the bet was OFF because of lack of funds from one of the parties! Pulp mentioned that Lolli told him about the dues from MM - but he should also have mentioned in writing with a copy to MM! OT thammud, Pulp clear ga mail lo communicate chesaadu kada that he is assuming the bet is ON ani- both MM and Lolli had an oppurtunity to respond saying that the terms were not met or something like that! As a mediator it was MM's responsibility that he made both parties clear whether or not the terms and conditions were met and whether the bet was on or not! To rest all, 1. On May 6th mediator has received money from one party( pulp ), mediator confirmed via email that he has rcvd money from one party ( pulp). In addition, mediator has also stated that he will confirm once the second party also send the money. Implied meaning and general procedure is : Only if mediator confirms that other party also sent money, then only bet exist 2. Mediator did not confirm till date that second party sent the money...aithe second party money ichaaro ivvaledho elaa ichaaro ela ivvaledho secondary ...it doesnt matter actually..its between second party and mediator...but coming back to bet...it was never ON because mediator never confirmed to first party ( pulp ) 3. On May 7th , Pulp emailed mediator and other party stating that : Since i did not hear anything from you guys otherwise, i assume that bet is ON ! My opinion : It doesn't work that way....it should not...-ve contract signing antaaru daanni ! Mediator has to say whatever bet is there bet or not ! bet parties should NOT assume things....... as far as the email evidences i have, Mediator never confirmed to the parties so...BET NEVER EXIST !!
