My interpretation is article 3 in its right spirit should be used to force the formation of a state in unusual circumstances like war, national security, natural disasters. In those circumstances, it can ignore state's opinion. So in this case, Centre has used Article 3 but has failed to provide a single valid reason for the formation of the state of Telangana. I think this will become one of the key questions from Supreme Court. | ||

Judiciary makees sure that constitution is implimenteed. Parliment cannot just pass a bill as per their whims and make it a law bypassing the constitution. It has to first amend the constitution by absolute majority to make any amendments to the constitution So Bottom line...parliment just cant pass a bill and say it is done if it is overiding the constitution.
