Same employer holding 140 no need file perm? Need new 140 for EB3 Diff employer with prev employer holding 140, perm needed? Perm is needed for GC process anyways, but EB2 vs EB3 is decided during 140. so if you have filed PERM & 140 already in EB2, next step is to file 140 for EB3. | ||

file new I-140 (no premium processing allowed in this scenario)... Wise aa antey, you never know...I originally had EB3 and fought with my company to file in EB2 and got it filed this year...so have both the applications but going with EB3 given the current trend...if things go back to how they were (i.e. EB2 being ahead of EB3) then tough luck anukuni EAD tho adjust aypothanu, but I am hopeful that final action dates will move making my PD will come current in next 3 months though... | ||
