33% on the income between $208,850 and $372,950

Married Filing Separately Filing Status

28% on the income between $68,525 and $104,425; plus $13,318.75
33% on the income between $104,425 and $186,475; plus $23,370.75


So instead of both of us paying @ 33% tax... one will pay 28% in the second case.

you can do it. memu kooda filing separately first time. again it depends on lot of factors . talk to CPA if you have child expenses, house/student loans, dependents, donations, expenses, proft/loss . iddaru itemize cheyyalsi vasthe issues vunnayi.

Please chek it up again. In most cases Married filing jointly gives the tax advantage. Put the figures in your tax software and run the comparison report(Jointly Vs Seperately). I never saw the case that 'married filing sepratly' giving more advantage than 'jointly'.

Married Filing Jointly

33% on the income between $208,850 and $372,950

You may not be eligible to claim the tax benefits like
Child care credit, Tuition & fees deduction etc etc
there are other deductions which are listed for separate filers.

Yes. You can

for Federal, it doesn't matter. some states have so many restrictions. It is very complicated when you file seperately by living in the same address(Only some states like..Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington or Wisconsin.)

Can you file "Married filing separately" even if you live in same house?

I wanted to file separately but CPA said you can't as you both live in the same house. That didn't sound right...

I can save huge tax if we file separately as we will be in highest tax bracket when we file together...

Any ideas?
