Link..how many years do you have on your H1...if your 6 years have been used up...you are better off using your EAD..as H1 does not serve your purpose any way.. If you have time left on the 6 year limit of H1..then also use EAD..because if something goes wrong on EAD/485...you have another status to go back to... Using up H1 time (the first 6 years) when you have EAD does not make any sense...if you are not with your original employer.. | ||

My assumptions on your case.. You have EAD/i-140/485 with company A, they cancelled your H1. ( You worked for more than 6 months before joining company B). Now, you are working with company B on H1, and your wife uses EAD Your questions: What happens if company B lay-off you and cancells your H-1? I know, even you are having EAD you are working on company B , H1 visa.. (EAD used as safe or for your wife). In any case, You will not be in OUT of status, as your i-485 pending. If you have EAD, you are Authroized for work. To fix: Find any desi company, who willing to transfer H1 and attest your AC21, then you will be fine. | ||
