ante EB quota for FY2013 = 140,000 + 18,465 = 158,465

so EB1, EB2, EB3 tala 45,321 vostaayi

ante EB2/EB3 India/China tala 3218 vostaayi..

lets take eb2..

Eb2 India/china total kalipi = 6436..

Murthy emi cheppindi few mons back (confirmed by other top law firm sources as well)

that 13K spillovers eb2 lo India/China ki available avutaayi (based on the 140,000 quota rule..Quota for this year is no more 140,000 it is 158,465)

apatiki ippatiki eb1 baane taggindi kaani eb2 m, p, row baa peprigindhi..

so last year 41K ki 10K spillovers vosthe..aa murthy lekka prakaaram only 4K spillovers ravaali..kaani now eb2 quota is 45K..so 4K+4K = 8K spillovers ravachu..alaane eb1 nundi 6K (for sure enduku ante last year 2K + ee year additional 4K in that category and inkaa ekkuve ravachu as eb1's are going down)

Spill over from FB to EB2I/C: 13K

Total available from spill over 28K(excluding normal allocation which is given to porters as we know from last 3 months same date hence monthly quota = porters demand)

Demand from March 2013 DOS data up to 1st January 2009 is : 23,975

Assume 4 months demand is 4,000(conservative figure),

Most likey September bulletin will have EB2 cut off date would be May 1st 2009.

By this time: Pray that CIR would be in place- mainly to remove country cap

Or else, porters might increase exponentially and make PD dates go back again to 2005 making this a yo yo game.

Exceptions for Visa Revalidation Benefit

While the automatic visa revalidation process can be a great benefit to many foreign nationals who wish to travel briefly to Canada or Mexico, there are limitations on the availability of this option.

Readmission under the contiguous territory rule is not available to those who apply for new visas at one of the U.S. consulates during a visit to Canada or Mexico. So, if an H1B worker with an expired visa goes on a short trip to Montreal and applies for a new H1B visa, the contiguous territory rule will not apply. Of course, if the visa is issued, the foreign national can simply return to the United States in H1B status using the new visa. If, however, the visa is not issued, s/he does not have the automatic visa revalidation rule available to allow reentry to the United States.

ante EB quota for FY2013 = 140,000 + 18,465 = 158,465

so EB1, EB2, EB3 tala 45,321 vostaayi

ante EB2/EB3 India/China tala 3218 vostaayi..

lets take eb2..

Eb2 India/china total kalipi = 6436..

Murthy emi cheppindi few mons back (confirmed by other top law firm sources as well)

that 13K spillovers eb2 lo India/China ki available avutaayi (based on the 140,000 quota rule..Quota for this year is no more 140,000 it is 158,465)

apatiki ippatiki eb1 baane taggindi kaani eb2 m, p, row baa peprigindhi..

so last year 41K ki 10K spillovers vosthe..aa murthy lekka prakaaram only 4K spillovers ravaali..kaani now eb2 quota is 45K..so 4K+4K = 8K spillovers ravachu..alaane eb1 nundi 6K (for sure enduku ante last year 2K + ee year additional 4K in that category and inkaa ekkuve ravachu as eb1's are going down)

eb4, eb5 rendu kalipi last year anthe ivvachu like 5.5 (endukante perigina aa 2.5..extra filings ki potundi..

so worst case scenario: 8K + 6K + 5.5K = 19.5K spillovers vostayai..(which is still less than last year but Ok)

kaani 19,500 lo 85% India ki 16575 + normal quota for India this year is 3218

so 16575 + 3218 ~ 20K vostaayi (remember this is worst case)..

kaani last year USCIS/DOS kalisi 303 EB visas waste chesaaru..

tappudu reports/news latho 10K spillover ki 19,500 spillover reality picture DOS ki teliyakapothe use ledhu..CO definite ga ee new stats ni correct ga use chesukoni eb ki visa waste avvakunda use chestaadu ani hope..

oka vela 20K vosthe..porting vuntundi kabatti..worst case Q3 2008 and best case end of 2008 ki reach avutaayi dates..by the end of 2013.

Alabama cheppinattu meaningful CIR pattuku randi few months lo (current oohaganaalu by sep) santhakam pedatha..if that happens, then it will become law in Nov 2013..ante FY2014 ki use avutundi..what ever may be the final form of the law, it will increase EB quota to some extent or may be country limits for India might be extended..something benefit is going to happen..
