Labor(PERM) and i140 (Immigration petition) both are being OWNED by the company, not the candidate. So, you need to keep a copy of the approved i140 while requesting the 3 year extension. Just mentioning the receipt date on a paper/letter doesnt work. If you are at the VERY EXTREME end of the options, Go online, take the online status using the receipt number, print it and attach it.(but high possibility of an RFE for the copy of the approval). Who knows the officer might be drunk in the early morning.. you may get lucky. | ||

As long as you have approved i-140 from you previous employer you can get H-1 3 yr extension from a new employer..He will still have to start the Perm and I-140 once again from new employer but retain the old priority date 08/24/2012-167.4 lbs 02/8/2012-181.2 lbs 01/04/2012-187 lbs | ||

Nope you need I-140 copy to request 3 yr extenion
Yes they don't have to give you and you cant do much. You can request USCIS for FOIA (Freedom of Information Act and Privacy Act). It will take between 2-3 months to get a copy of your I-140. So ask your new company for a 1 yrs extension and request a FOIA in the mean time. Once you get the I-140 copy next year ask for a 3 yrs extension. you can get 3 yrs extn by using I-140 approval # , anni companies general ga I-140 copies ivvaru as its their property. Also I think there is a way to apply and get all the your related documents(including I140) incase company denies it (i guess it will take 6 months)..correct site link naa daggara eppudu ledu kaani but research on that also if you time. | ||

Can we get H1-B extension for 3 years with just I-140 approval # but w/o the copy of the I-140 receipt?? Can a company reject giving copy of I-140 approval notice.. My company is declining to give.. Thanks! |
