First of all "us salary tho india lo pani chese option kooda vachindi anukundam (WFH)" is illegal. If you stay in India for more than 6 months, your earnings need to have some legal basis in India. This is with respect to taxation. I don't want to get into an argument as to how anyone will notice and all. Now coming to the point. If you need to stay away from the US for more than 6 months in a single trip, you will have to justify the trip every time. If you stay for more than one year, you will be grilled for 3-4 hours. If you have back to back trips of 5.5 months each, you will still be questioned. To solve this you need to apply for a reentry permit(I-131). This will allow you to stay away from the country for two years without making a trip. This will cost you around 365 dollars. This will be approved by default. You don't need to worry. If you are applying for naturalization, any continuous trip of more than a year out side the US will break your continuous residence requirement. Even if you have the reentry permit, you will not be exempt from breaking the continuous residence requirement. after you come back to the US permenantly, your time will start ticking for your naturalization. To avoid this take a trip of at least a week in one year even if you have I-131. Now if you have already completed 36 months of your green card and you were physically present in US for 30 months out of those and your US employer can give a letter that your presence in a foreign country is needed to improve the trade of US corporation in the foreign country, then you are eligible to apply for N-470 (preservation of residency for naturalization). This in addition to the reentry permit will allow you to stay in foreign country and still apply for your naturalization. you just need to continue filing federal taxes as US resident. The 36 months and 30 month requirement is not in any USCIS manual. so nannu kummaddu. It is just a practical calculation that I have done. One of my close friend went through this route and hence I know ins and outs of this calculation. Our friend Mr. Sienfeld did not mention about citizenship but I took the extra luxary to answer that question too. | ||
