Life imprisonment and acquittal On 28 November 2006, Soren was found guilty in a twelve year old case involving the kidnapping and murder of his former personal secretary Shashinath Jha. It was claimed that Jha was abducted from the Dhaula Kuan area in Delhi on May 22, 1994 and taken to Piska Nagari village near Ranchi where he was killed. The CBI chargesheet stated that Jha's knowledge of the reported deal between the Congress and the JMM to save the then Narasimha Rao government during the July 1993 no-confidence motion and an act of sodomy was the motive behind the murder. This is the first case of a Union Minister of the Government of India being found guilty of involvement in a murder. On 5 December 2006, Shibu Soren was sentenced to life imprisonment. A Delhi court rejected his bail plea, stating: 'We cannot overlook the fact that the appellant (Soren) has been convicted after a detailed and elaborate trial only in November 2006 and sentenced in December 2006. CBI files charge sheet against Jayalalitha Chennai, July 31 (IANS) The Central Bureau of Investigation (CBI) has filed a charge sheet against AIADMK chief J. Jayalalitha for allegedly accepting gifts worth more than Rs.20 million in the 1990s. Two of her confidantes - Azhagu Thirunavukarasu, a relative of N. Sasikala, and K.A. Sengottian - both former ministers, have also been charged with abetting the crime. The charges against the former Tamil Nadu chief minister have been filed under Section 11 of the Prevention of Corruption Act. The 2,000-page charge sheet, filed in the court of principal judge Meenakshi Sundaram, cites 285 documents and 149 witnesses. According to CBI sources, Jayalalitha received 89 demand drafts worth Rs. 20 million, drawn on various banks in the state and purchased in the names of 57 people, as well as Rs.1.5 million in cash. Twelve of the 57 names were found to be fictitious. Some of the witnesses reportedly told the CBI that they had purchased the drafts at the instance of the two former ministers. The drafts and the cash were deposited in Jayalalitha's savings bank account in the Canara Bank here. The case was initially registered in 1996, under the Prevention of Corruption Act of 1988, on a complaint made by the Director General of Income Tax. The case was taken over by the CBI in 1996 for investigating an alleged offence of criminal misconduct by a public servant relating to gifts allegedly received by her, which she had disclosed in her income tax returns. Jayalalitha allegedly used the drafts to avail of an immunity scheme announced by the central government in 1991-92. A chargesheet against the former Chief Minister, Ms. Jayalalitha, and the AIADMK M.P., Mr.T.T.V.Dinakaran, was filed today in an anti-corruption case by the Directorate of Vigilance and Anti -Corruption (DVAC). The case relates to the alleged purchase of two hotels in London by companies floated by Mr. Dinakaran. The DVAC's charge was that Ms. Jayalalitha had illegally funnelled funds to foreign countries and utilised them to purchase the hotels in 1994. The Principal Sessions Judge, Chennai, Mr. S. Ashok Kumar, before whom the DVAC presented the chargesheet and related documents, posted the case for April 17. Relating to offences to the tune of Rs.43.98 crores, this is the second ``disproportionate wealth case'' filed by the DVAC against Ms. Jayalalitha. In the first case, she, along with Ms. Sasikala and two others, is facing trial for alleged offences of amassing wealth to the tune of Rs. 66 crores. The chargesheet stated the DVAC investigation through the Serious Fraud Office in the United Kingdom disclosed that during her Chief Ministership (1991-96), Ms. Jayalalitha entered into a criminal conspiracy with Mr. Dinakaran and funds were funnelled out of India through ``other than regular banking channels'' with his help. The money was used for purchasing DDs from banks for $300,000 in Sri Lanka, for $3.58 millions in Dubai, for $476,200 in Malaysia, $1.59 millions in Singapore and for $4.53 millions in Hong Kong. Mr. Dinakaran had, meanwhile, acquired three companies - Dipper Investments, registered in British Virgin Islands, Banyan Tree Enterprises and Turnkey Industries (A British Virgin Islands company)- and transferred the funds to the bank accounts of those companies with the Barclays Bank, Sutton Branch, London, by depositing the same drafts. During 1994, Mr. Dinakaran arranged to convert the funds into about £ 6.83 million and transfer them to the account of a solicitor, Mr. Naynesh Desai with the Natwest Bank, London. Another £ 1.32 million was also clandestinely transferred from a different source and the total of £ 8.15 million, equivalent to Rs.39.56 crores was used to purchase the Hops Croft Holt Hotel at Steeple Aston, U.K., purchased in the name of Godfrey Resources Corporation, and the Slaley Hall Estate, Hexham, U.K, in the name of Adelphi Enterprises, both companies floated by Mr.Dinakaran. The two hotels were sold away during 1998, for a sum equivalent to Rs. 121.53 crores. Mr. Dinakaran was also found to have made other investments and incurred expenditure on behalf of Ms. Jayalalitha, for Rs. 4.41 crores for facilitating the purchases. During the period Mr. Dinakaran did not have any pecuniary resource that would have enabled him to acquire the assets. When she was given an opportunity, Ms. Jayalalitha, the chargesheet said, did not come forward to furnish a satisfactory account for the expenditure/acquisition. While Unitech has been issued notice for Rs 65 crore, Virgin is alleged to have committed FEMA violations for Rs 135 crore and Milky Developers for Rs 120 crore. The ED has given the firms a month to reply to the notices. âAs per the findings of the ED, the three firms have allegedly drawn foreign investment without intimating the RBI, defying the Foreign Direct Investment (FDI) policy,â said a top ED official. The firms can appear before the adjudicating authority of the rank of special director against the notices. âThe forex contravention under FEMA is done by these companies by not reporting the receipt of funds from abroad within the stipulated period of time to the RBI, in not reporting issue of shares to foreign investor within stipulated period of time, and in purchasing shares of an Indian company from the funds of FDI,â added the ED official. The ED probing the telecom companies under the FEMA and PMLA in the 2G scam has alleged that there was Rs 10,000 crore of FEMA violations by telecom firms after they were granted licences. Last year, the ED had charged telecom companies for FEMA violations to the tune of over Rs 4,300 crore. The companies which were charged by ED were Swan, Loop and S-Tel. Among them, Shahid Balwa-promoted Swan Telecom, committed FEMA contraventions to the tune of Rs 3,608 crore.
