(A) Determining the Priority Date. In general, if a petition is supported by an individual labor certification issued by DOL, the priority date is the earliest date upon which the labor certification application was filed with DOL. In those cases where the alien’s priority date is established by the filing of the labor certification, once the alien’s Form I-140 petition has been approved, the alien beneficiary retains his or her priority date as established by the filing of the labor certification for any future Form I-140 petitions, unless the previously approved Form I-140 petition has been revoked because of fraud or willful misrepresentation. This includes cases where a change of employer has occurred; however, the new employer must obtain a new labor certification if the classification requested requires a labor certification (see the section on successorship of interest). I140 ee reason basis meeda cancel chesaaru ane daani batti vuntundi fraud etc.. aithe poyyinatte..u cannot use old date.. vere reasons valla use chesukovachu (as per law) kaani it all depends on your IO officer (vaadu strict aithe potundi ee reason aina) ... |

for my friend. I'm working for company A and got I-140 approve through them in EB-3 category. Now I'm planning to move to company B to port the GC process from EB-3 to EB-2 as I got qualified to apply GC in EB-2. Now my current employer ( company A ) is saying that they will hold I-140 just for six months or may be one more month, in the mean time I have to apply GC through company B and should be in a position to file I-140 before he cancels I-140 which I already got through his company. Actually I want to retain my EB-3 priority date, use the same date for EB-2 Is it true that if any company cancels I-140 then we will loose the priority date? Any info will help. |
