With an Approved I-140, that has been approved for more than 6 months through some older Employer, any candidate can continue filing H1 extensions and transfers with any Employer for any number of times.

naa friend okadu JPMC lo idey situation. 2 years ago moved to FTE, JPMC is not initiating GC, he's relying on Approved I-140 from Older Employer for further Extensions. Confirmed fact from JPMC Immi-Attorneys.

technically YES but current scenario lo u never know better safe than be sorry and make sure file perm and 140 asap with new employer.

140 withdrawal is not required legally or by USCIS guidance.
Desi employers withdraw as a measure of vengeance. Other employers don't usually withdraw.

Approved I-140 more than 6 months, candidate is safe.

you cannot get extensions on a revoked I140....new employee ki change aiyaaka you need to immediately start the GC process again before next H1 extension date arrives.....priority date from previous I140 can be retained...

I don't think . If the I140 is approved for more than 6 months , employer will not able to withdraw.

AFAIK - he can continue to work by requesting H1B extensions.

But this is only "my" reading of the situation. Please ask your friend to reach out to his new company's attorneys -- or some desi immigration law firm to double check.

Guys, this is the situation with one of our colleagues here. He is in in his 7th year on H1B, 140 approved 3 years back and priority date is 2014 Feb. He got a job offer from new company (US based big firm). They said they will transfer (or apply) H1B but they did not gurantee about Green Card sponsorship. They say it depends on Performance and how the team/company is doing at that time.

Friend is ok to join the new company as he thinks he doesnt need his green card to be started immediately. He says as long as he gets new I140 (from new employer) approved by the time his priority date is current, he is good to change emmployers. Going by the current trend, vaadi priority date current avatam is a distant dream.

I was wondering can the current employer withdraw his I140? Epudo approve ayina I140 meeda H1B extensions (from new empoyers) vastaya? If I140 is withdrawn and new employer hasnt yet started GC processing, apudu enti situation? If nothing like withdraw, aythe we can keep changing employers with that approved I140?
