Timepasskosam:

don't need perm-140 if you switch employer even though you never filed 485

if that is the case why ppl are hesitating to join new companies with good billings or even FTs

He is pretty good with immigration info

Antha ledu thammi, I also have learned like you and others here. I may go wrong at times.
But for this topic, after the Timepass original post below, I have double checked and posted few references from Frogoman etc in my very first reply of the tread.

Timepasskosam:

All the candidate needs to do his file AC21(?) and file 485 when the dates are current with new employer

This is only correct if that person has received EAD after filing 485.
Otherwise start over but recapture the date.

new employer should file perm,140 unless you are going back to same employer after changing to new employer. Let us say you moved A to B and decided later come back to A then no perm needed just 140 if they withdrew.

idhi jarigi 4-5 months ayyindi..another employer wanted to file one more petition after denial as I had a valid I-94, but when I contacted attorneys, Murthy and Rajiv Khanna, they said the safest way is to go out of country and come back on h4 and then try converting back to H1.....so left country within 4 days after denial, got h4 stamped the next week itself in chennai, came back and applied for H4 EAD...got the EAD now and joined the same company, same position a couple of weeks back...EAD valid for 2 more years, so ee lopu malli h1 try cheskovaali..kaakapothe whole scenario lo lot of stress for family and uncertainity till I joined back...

Just to let you know, 485 has NOTHING to do with the employer. Its BENEFICIARY owned

Brighton:

idedo timepass question la undi...
New employer must start your perm and 140 even you got approved 140 from old employer.. all you can port is the date from your old perm

This is not true:
Here is the basic idea of Approved i140 taking to next employer
I-140 portability – when the beneficiary can take his/her PR case to a new employer without starting the process over again.

An approved I-140 will remain valid for employment
Same or similar is more precisely defined
Also includes the language re: intent for applicant to be employed in the position "within a reasonable period upon the applicant’s grant of lawful permanent resident status."
Also read it here: https://www.fragomen.com/insights/alerts/uscis-job-portabili ty-rule-takes-effect

I will dig for the actual legal reference and post when I get time.

Jeffa- in one of the threads you mentioned that there is no need to start PERM-->140 process if a person with approved 140(no EAD or not filed 485) joins new employer in similar role/industry
All the candidate needs to do his file AC21(?) and file 485 when the dates are current with new employer
Is this correct?
Anyone in our DB or know some1 did this sucessfully
