how? if ther is of evidence of infidelity, divorce can be filed. the option was already there. here the advantage is only to the third party.

hmmm i should stop trolling abit probably...

anyway - There are two things we need to understand about this law

1) Under this law, only a husband can file an infidelity case on wife and another person. Even when such a case is filed, only the "other person" is committed with the crime. probably a good news for guys in general :d, as they cannot be charged anymore for such "crimes".

2) like i alluded in my first point, only a husband can file infeidelity case, a woman cannot file an infidelity case against a husband, even she has proof that he is involved with another man.

now this law is not valid anymore, so its a win-win for both guys and gals. guys cannot be charged for hooking with another married woman, and gals have the right to say that they have equal rights as men :D

the thing to note is, infidelity can still be used for a cause of divorce. it was earlier too, that is a wife or husband could use this reason for a divorce. that does not change.

Marriage is a contract under Civil Law. A breach of trust in a Civil Contract shouldn't be a criminal offense. Similarly, in universal law, a unilateral termination of a civil contract isn�t a criminal offense either. The cornerstone of Civil Law is compensation or damage; not punitive measures. Just as punishment is the cornerstone of Criminal Law.

498A misuse is at its peak. While I agree with you about the misuse, the law should be bit more clear instead of the unilateral woman-pro one way treatment for a simple complaint.

The nasty ownership of husband on female personal choice is REMOVED. In the past, after marriage, a female can not have X with any other. If so, the husband(nasty ownership) can prosecute the other subjects who had X with his wife regardless of if there is a willing X between two humans in the situation.
So, the OWNERSHIP is removed.

Very welcoming change.
Ref: Section 497 of the Indian Penal Code makes it a crime for a man to have intercourse with another man's wife "without the consent or connivance of that man."

The law gives a husband exclusive right to prosecute his wife's lover — and does not grant a wife power to do the same. It does not penalize the woman, nor any married man who has sex with an unmarried woman.

The 158-year-old law dates back to Victorian times, during British colonial rule of India. The penalty for adultery was up to five years in prison, or a fine, or both.
