lol adi nenu manual ga apply chesa for my wife, touchwood it went fine, i have also done myself for my wifes h4 to f1 Cos filing and rfe response, but my friends wife rfe seems a bit complicated. will check with murthy firm today, last date for rfe is oct 7 | ||

not true completely Firstly you have to take full time course for the last nine months before you apply for an OPT (It doesn't matter which visa you are on as long as you satisfy these requirements) My wife she did her Master's on H4 for the first 4 quarters (12 months) with full time course load...last quarter ki mundhu December lo India velli F1 stamping cheyyinchukoni vachindhi she did not have issues with OPT or OPT extensions | ||

her H4 is expired when the F1 was submitted. the second H4 app was sent after 4 months. if he voluntarily cancels the F1 now, there will be a gap of 4 months for which she will be counted to out of status. Gamble ante if he sends cancellation letter for H4 now and if F1 is rejected after the RFE reply, will it be a case where both H4 and F1 is rejected? if so what will be the options? | ||

You cannot have a change of status from one category to another and at the same time have an extension for the original category. It violates the status updates. Either he can have F1 or H4, If he wants F1, then he has to take a gamble and send H4 cancellation letter. Or request F1 to be cancelled and request for H4. | ||

hi guys, my friend have applied for his wifes change of status from h4 to f1 in january . He have also applied for h4 for back up in april this year . However for f1 change of status application which being processed now received a rfe in which it stated to cancel your h4 extension, please submit a cancellation letter. question entante if f1 gets rejected then they wont cancel the h4 extension application pending because they submitted the cancellation letter with f1 rfe response? Is this cancellation only in case of approved f1? evarkina idea unte please help... |
