This is absolutely correct and the way to go. Many folks uses EAD while AOS is pending. We should avoid using EAD as much as we can and hold on to keep renewing H1 as long as we can till AOS approved. The reason is that EAD usage would pause or cancels the H1 continuous renewal link. Also EAD is attached to AOS. If AOS goes south for some bad luck, the candidate loses the Parallel valid H1 immunity and got to leave the country. If we keep the H1 continuously renewed and used it, we will have an option to refile the GC with the old PD. (This is exactly what saved me at a very critical moment). If anyone shows EAD to any employer, they would use it IMMEDIATELY instead of H1, the reason?? Its less complicated to the employer. So, dont ever say that you had an EAD right at the first. If you had an opportunity which is more valuable than losing your H1 renew ability, worst case only, use EAD. | ||

This is not True. Again, lets go back to the basics. What is EAD? EAD is an additional interim permission to work in US while your AOS is in pending state(Remeber, EAD will be given for ANY AOS. My mother got EAD when she was filed for 130+485 when she was 70+). As a side note, Advanced Parole is also same as EAD, just a by product form the mother 485. Now issuing EAD has no effect on ANY existing petition process and EAD doesnt drive any other pending immigration petitions,(But USING EAD impacts the existing non-immigration petitions like H1, which has a dual intent of work+live is inbuilt into it). Having said that, 485 can never be saved since an EAD or AP was issued. 485 is the last adjustment while i140 is the ACTUAL APPROVAL of your Immigration Petition(aka Green Card eligibility). H1B: Non-Immigration petition i140: Immigration petition Go back and READ the TITLES of these PETITIONs. While a fresh H1 doesnt require any existing status adjustments, i140 requires an adjustment of status (if you are already in US with another status OR Consular Processing if you are outside United States). Draw a tree. with stem of PERM and i140 and 485. then branch out EAD and AP. EAD and AP are fully optional on 485 petition. | ||

As far as I can recall, Once EAD is issued, even if 140 is denied based on a recall, his GC may still be approved. Do not quote me on this. This was based on what I read on Trackitt a few years ago. Till 485 is not rejected, EAD holds good(unless EAD is expired before the final 485 rejection date). His dependent petitions ( called derivatives of original 485 petition) would also gets denied and thus any by-products(EAD, AP etc) of the respective 485s would deemed invalid at the time of the 485 rejection. Its like a tree stem/branches. once you cut the main branch, the sub branches, its leaves etc are automatically become lifeless. | ||

I read back your message, my answer etc once you said that you will take my word. Here there is a common sense to be used instead of a hard citation of a rule. GC is for FUTURE employment. As per the law, one doesnt required to be in United states in the entire life time before the APPROVAL of the GC. Period. Having said that, your statement is not right since you have referred that beneficiary must be working with the old employer AT THE TIME of 485 (could be filing). Since i140 is ACTUAL immigration petition APPROVAL. once its done, the beneficiary gets the steering wheel (means the beneficiary owns the rest of the process aka Adjustment of his non-immigrant status to immigrant status using already approved immigration petition(i140). At this point, there is NO present involvement of ANY employer(old or new), all the beneficiary required is .. a FUTURE EMPLOYMENT OFFER letter confirming that the employment offer mentioned in PERM and i140 petitions is STILL OPEN for this beneficiary. Having said that, current status of being employed by ANY EMPLOYER(including old or new) is NOT REQUIRED at the time of AOS filing. Also AOS is NOT REQUIRED to be filed by the EMPLOYER ONLY. Employee ALSO can file by themselves. Thats the theory. But practically, being currently employed by the future employer at the time of AOS cut short many open issues(like Validity of future job, prevailing wages etc.. Now do you want a citation still, I dont think I can spend time on search for them, If you can help me to understand my above understanding, I would stand corrected. | ||

I have seen the RFE and the form that uscis asked my friend to complete...they are asking are you still in the same role as filing or if you have moved...they are asking for new company details and the new job details with some portions to be filled by the candidate and some portions to be filled by the new employer. Few attorneys suggest proactively but majority of them suggest responding if there is an rfe. | ||

Did your friend get his EAD already (since he filed 140 and 485 concurrently, he should have gotten hi EAD after 140 was approved).. If he has EAD, his case gets trickier. That has been suggested as a precautionary measure for years. Just like 180 day rule for after filing 485 and 365 days rule for after 140 approval. Some of my friends went back and worked for initial GC filing company when their dates became current for filing 485. Sarigga daanike AC21 kaavali. i140 is owned by the EMPLOYER but NOT EMPLOYEE. When old employer gets i140 approved for this employee, it means this employee's permanent immigration is approved. Officially PERMANENT VISA is approved. But once 180 days passed, if the NEW EMPLOYEE files AC21, the BENEFICIARY PART of the approved immigration petition still continue to be attached to the EMPLOYEE and the new employer would be replaced as a FUTURE EMPLOYER upon the 3rd stage (AOS) is approved. At this point, the old employee loses his approved EMPLOYABILITY of this employee under the same approval. In other words, old employer revoking has no effect on the employee. Thus, AC21 is more neglected in general assuming that the old employee doesnt revoke the i140. This is true but at times when a bad separation of employer-employee happens, OR ANY OTHER i140 petition of employer hits a "Ability to Pay" RFE, then the employer would try to clean up all dangling dead links(orphan i140s) since the "Ability to pay" is cumulative(in other words, cumulative of all currently pending i140s and i485s) for that employer. | ||

AC21 is when you change your job after applying I-485....its not for people who did not apply 485...imagine a situation where somebody's priority date became current, they filed 485 and after that if they change their job before getting GC...in such cases they need to file this AC21 stating I moved to another job with similar ob duties...if they don't file it, USCIS can reject the pendng 485...just 140 approve ayyaaka job change aithe elaago malli kottha employer tho malli labor and 140 file cheyinchukovaali before you apply for 485...so alaanti vaallaki no issues...basic thing is after u file 485, do not change the job..if u change make sure file AC21 | ||

What is AC21?.. My i140 had approved with Emp A in 2016 I moved to Emp B in 2017 with old I140 from EMP A.. H1b approved for 3 years.. stamping also done in Hyd.. I moved to Emp C in 2018 with old 1140 from Emp A. H1b approved for 3 years again.. Lawyers didn’t mention about AC21 in either instances.. Technically he can because GC is for future employment. But he needs to work for first 140 employer at the time of filing 485. Risky though. not filed ..for a family friend i know.. He changed job after he got I 140 ......took it easy or did not follow up with employer.. Recent ga old employer call chesi ... 140 denied ani cheppadanta... looks like REfe also issued for 485 , by asking to prove that he has filed AC21 .... awaiting for more details..
