No thammi.. Go back to the basics and think through that. H1 is employer owned. He says: I got a job here in US, I didnt find the employee of this skill set locally, I will import him temporarily please permit me. USCIS says go ahead. Here the employer gets permission to employ foreign worker. Now Employer 2 comes and files the similar petition and gets approval. There is no reference of whom he employs in first stage (LCA) I have seen LCAs with the beneficiary names on it but its not required. All that employer needs to do is to satisfy the terms of the permission(mainly privileging wages and normal employee benefits) as long as he didnt revoke it or the term of the permission is valid AND the beneficiary is on US soil. Here the one and only need for the employee to be on H status is to be attached to AT LEAST one such employee all the time while on US soil. | ||

ONLY ONE is WRONG. ANY or ALL of employers who sponsored and got the approval of any H1 petition where this guy is beneficiary :-) H1 is not employee OWNED. Its EMPLOYER owned. In simple terms, you can have n number of job offers and also you can work on N number of jobs AT ANY TIME :-) | ||

LoL. Nenu ennallanundo arachi chastunnaa.. each employer petition is mutually exclusive. A petition is really nothing to do with B petition. When A revoked it or USCIS revoked it then only A would become invalid. Till then its valid. So, your friend can work for A at any time (in parallel to working with any other employer too). :-) | ||

He can happily go back to A and work...the rule is at a time, he ahould be working for only one company that sponsored his h1 and he did as per the rules..he worked on reciept notice for B..it does not make him illegal or out of status..i confirmed this with attorneys in a few calls.. | ||

Key point here is he has paychecks with company B, so he stopped working for company A, though H1B was not revoked. Normal scenarios, he is ok, but things may have been changed recently, on how USCIS views this case. Better to consult a experienced immigration lawyer asap. | ||

I think they can easily go back to old employer...many people dont quit their old job until the new H1 is approved for the same reason...if it gets denied...they can continue in the old job. | ||

Friend was with a desi consultancy(A) till May end. Filed for H1 transfer in June and got rfe followed by denial on August 17th. Have paychecks with B for this period. A hasn't revoked his H1, can he go back to A and continue to work? |
