Swavas:1) Can I join MS now and convert to F1 after few months. So I will get OTP and may be join back H1B with I140 approval. I am very much interested to go back collage.
Yes. But OPT immediate ga vastundo radoo. You have to be enrolled as a full time student and produce your offer letter to qualify for OPT.
Swavas:2) Move to new Company and get GC processed --> if I140 not approved before end of 6th Year move to H$ and move back to H1B.
Once you join new company, most companies require 6 months to a year before starting GC process. If you get past that, Perm/Labor will take 6 months to be filed.... If approved, you can get 1 year H1 extensions while I140 is pending. Assuming you can convince, future company to start Labor process, right away, you should be good for 1 year extensions until I140 is approved. Then 3 year extensions. |

2 months lo 6th year enter ayyaka, very risky, but i won't say not possible to complete Perm Labor, I-140 and get 3 years extension. 1) Your best bet is to find a job within next 2 months, complete H1 transfer successfully in premium, get Perm Labor initiated on Date of Joining, max within 30 days of joining. Impractical, does not mean impossible. May happen, but will be a miracle. 2) Another option, initiate GC for wife. By the time you are completing 6 years, you switch to H4. Depending on your wife's I-140 approval date, and 6 months beyond, you'll become eligible for H4-EAD status based on your wife's GC. 3) Switch to H4, wait as house-husband for 1 year. you'll become eligible for H1 again after 365 days on H4, despite you did not move out of US after your H1 6 years expiry. Hello, In another 2 months I will enter into 6th year of H1B and no GC process started yet. For GC process I need to change company, but unfortunately one of the transfer got rejected. I have to be here in US fro few more years as my Wife's H1B is there til 2022. 1) Can I join MS now and convert to F1 after few months. So I will get OTP and may be join back H1B with I140 approval.
