Balu_gani:Max stay on L1B visa is 5 years...if he doesnt get GC before that 5 years he has to exit and wait for GC.
Yes..
Gochi:After 5 years he needs to get converted to H1 through lottery process and then can keep extending h1 till he gets gc...
Yes.. You need to convert to H1 else you need to leave after 5 years. One of my colleauge didn't get H1 4 times in a row and had to move to india. |

One:thats true on paper, but it wont work that way in reality
I did say this too in my original reply. read back
Thats what law says but practically: Filing GC on current L visa, its employer's own decision but can be filed.

Jeffa:C has nothing to do with the current or previous immigration (or non-immigration status). GC is for future job. It can be filed if the candidate has never entered into US in the life so far.

GC has nothing to do with the current or previous immigration (or non-immigration status). GC is for future job. It can be filed if the candidate has never entered into US in the life so far. Thats what law says but practically, Filing GC on current L visa, its employer's own decision but can be filed. Once your AOS is filed and pending, you can live in US legally(but living doesnt mean that you can work. You have to file EAD for work options while on AOS. So, as per the law, L visa holder can be filed for a future job by a US employer. |

A friend of mine is working here on L1B visa. What are his options for GC. I think 3 more years left on his status. Would L1 be extended if his GC application is pending like H1B cases? I am struck by the lightning of love and burnt beyond repair - Florentino Ariza
