Bhayya, extension deny ayyi and if i-94 already expired, daani tharavatha malli inkoka h1 apply chesthey first it will go for rfe or they will approve as a consular processing...that means we need to step out of country and come back in after getting a new visa stamp...bcos we are already out of status, they cannot extend or give new status while we are inside the country.. So best thing to do is, leave the country right away in a week and then apply for a new h1 and come back in after stamping... | ||

USCIS back in 2011 they were not deporting if ur status is under appeal or so ade big change and moreover now-a-days denials are higher so easier for them to enforce NTA policy | ||
