Most of the buyers go easy on breaking the contract even they might refund your deposit money too. I would suggest present your situation. If it is job loss of your spouse tell them your current financial position is not good, so mortgage loan might decline. For me I signed a contract with the builder, in one week later I saw a two years old home which matches my criteria, I decided to break the contract with the first one and decided to lose deposit in the worst case. But builder gave back my deposit without asking any questions only they asked me to sign a form. They have so much of demand.

If it is only $5k Loss,not a big deal to lose (but check if it is easy to get out)

If you plan to rent out (even temporarily ) and sell later, consider the costs of carrying it (like insurance,mortgage,Property tax,appliances/upgrades,maintenance which you will not get back) over the Home value appreciation (-listing/selling/broker fee)
The property value should appreciate atleast 5% if you have to breakeven

That is not possible MRHYD.. i did a mistake of going with the realtor recommended mortgage company(any both are good friends and ofcourse they gave me a good rate)

thinking of below 2 options
1. Move in for now, live in to for a year and then rent it out(living in it unless we get clarity on h4ead)
2. backout with money lost(estimating anywhere close to loss of 5000 on a 250K house)

that letter is enough to back out

If below 200K guess it might be better to close the deal and rent it out. Make sure the property can be rented out and community has no restrictions. SOme communities keep restrictions on renting

In most cases, you will not lose your earnest money.. or most of it

We went through very similar scenario 2 years ago in jersey

Put down 40K as deposit but then had to back out after inspection, appraisal got cleared.

Seller gave hard time for 2-3 weeks... which i can understand from their side..

Had to negotiate over multiple emails

Finally... seller attorney expenses 2K pay chesi remaining 38K i got it back

you can back up at any time if it is not new home.

before closing. after closing it is tough.

if appraisal comes lesser than quote, you wont get loan so you can safely walk out

About 5-6 years back I was in a similar situation and I got my earnest money back.
I had a job-location change but same city and provided that letter from the employer.

The seller can sue/claim damages for his lost time/expenses/lawyer fee etc and if he lists house and sells for less ,he can claim for the losses

But ,if you have discovered anything in the property that has not been disclosed buy the seller or agent, during inspection or otherwise,you can walk out of the deal and seller has to refund ..
For eg: You can get the property surveyed /inspected and if you find the dimensions of lot or even the area of home is not exactly matching,you can back out of the deal
If the listing talks about good condition of roof/appliances/structure etc..you can get it checked,'find some fault' and cancel the sale


But most of the time,the sellers keep the deposit and move on

usually there should be a problem, but occasionally they might ask for you to pay some amount if you have added alot of upgrades. its difficult to stay straight, but safer to invest in an attorney.

look into your contract ,see what contingencies you have..

like loan approval? financing, change in job


review those 10 times and go and talk to builder..

if he is easy they will let you go with out any problem..

other wise you have to loose your deposit

Need some advice.. I entered into an agreement to buy a house.(paid down earnest money as well)

What should I be looking out for if I have to back out(not because of property or appraisal)

Because of change in personal situation.(I was planning to relocate to my wife’s place of work.. but because of H4EAD, I am a bit skeptical now..)

Apart from losing earnest money.. what other expenses I should be looking at...

I have a lock in rate money and appraisal money(which I expect I am responsible for)

Even I don’t expect I will get earnest money.. any other financial implications which I will be responsible for???
