LoL let me explain you bit basics(anyone can correct me if I am wrong, with the official reference). i140 IS THE APPROVAL of your PERMANENT IMMIGRATION VISA(in other words, your Green Card is approved when you got i140 approved. For proof, read the i140 application type and try to understand it WORD BY WORD). 485 is JUST adjustment of status from non immi to immi. (this is the same process if you are living in US in non-immi status and got an immi visa approved.(family, eb, refugee etc...) If you have multiple EB petitions, each gets ONLY TWO stages (PERM and i140) to get them approved. You will use such approvals to request your AOS(Adjustment of your non-immi to immi status). Here those underlying i140s are NOT MUTUALLY EXCLUSIVES, the live independently as long as the job is open with the employer and the employer had the ABILITY TO PAY upon the status change | ||

There is NOTHING to maintain. You just keep both of them running. Employer has nothing to do.. just reply RFES(during AOS)on i140 (especially on the ability to pay). | ||

Thammi, each petition is independent. Mutually exclusive. one(in particular, the best) of them can be used for AOS. Even after filing your AOS, you can amend it to use a particular approval at any time before the adjustment of status. | ||

Jeffa brother.. My company did I140 in EB3 first. Later they ported the I140 to EB2. If my EB3 becomes current, can I use that I140 for 485? or since it is ported, my EB3140 is not valid and I can only use EB2 I140? veni.. vidi.. vici.. | ||

You DONT NEED to REVERSE or FORWARD across any 485 classes(Family/EB etc or within EB also), you can have n number of i140s at a time and the best can be used for the AOS approval :-) I had my EB2 and EB3 both alive till I got approval :-) they are simply like One Software Engineer Job and One Software Architect job offers, you can have both on your plate till you want to bite the one you want to eat :-) Its not Singleton Pattern :-) | ||
