03/01/2018: H-4 EAD Rescission Proposed Rule Publication Schedule Changed from February 2018 to June 2018 It appears the USCIS prepared an initial draft of its proposed rule with a schedule to publishing in February 2018 as published in the rule making agenda. However, USCIS learned that it needed to make a "significat economic analysis" which will take some time. Therefore, the USCIS has changed the schedule of publication of the "proposed rule" from February to June 30, 2018. The proposed rule may be published in the federal register with probably upto 90 days of comment period. It thus appears that the binding rule may not be published until next six months or so from now. Additionally, the reports keep stating rescission of "certain" H-4 EAD, raising a question of which H-4 EADs will be saved from rescission. The details will not be known until around June 2018. No Thammi... Unless and otherwise there is a Govt Order or status update, INS cant state this (no matter old or new). If there is a considerable issue (from INS point of view), every petition(including H1B or any other visas) can be probed to the deep.(including interview or sworn in statements). This is very common in non-family related Immigration petitions while uncommon in EB petitions. So, dont just count in with an unofficial opinion of someone :-) | ||

from trackitt Assuming they are not able to utilize the entire quota for EBROW (both EB2 and EB3) due to the interview mandate, those visas can be used for EBI (since applications filed before Mar-2017 dont have an interview mandate and are already per-adjudicated). EB2I could benefit out of EB2ROW since they have atleast 15K applications pending (IFF the RFE's for medical and sup-j start flowing within the next 2 months). EB3I could clear its current pending inventory and help EB1I as usual. | ||

Good news: People who applied 485 before need not to go through an interview. And all new applications need to go through an interview and it is taking 6 months to schedule an interview. This might create backlogs for new applications and unused visa numbers in a fiscal year. That may come down to Eb2. Eb2 might move faster in this June and July and hit 2011. 10k is expected visa numbers. Please do not ask questions. Just pray that it should come true. Bad news: People whose h1b is picked up after recent new memo are getting rfe's which cannot be answered. People are getting extensions for 3 months. very bad news for h1b extension filers. |
