As per my understanding second H1b transfer will also go to RFE asking on what status he was on for the Gap..they will not approve it blindly | ||

Best thing to do is, reply back to RFE..as its premium processing u will get a decision in a week after you submit your evidence....emanna thedaa aithe then ask client to start the h1 process as consular processing. leave US within a week and come back once new H1 and stamping is done..RFE pending lo unnappudu client transfer file chesthe that will also get rejected... oka Transfer petition in process lo undagaa second petition esthe its treated like a bridge petition...only if the first petition is approved, second one will be approved...if first is rejected then automatically second will also be rejected...endukante u already started working at the first H1B transferred job...adhe join avvakundaa unte(ante CTS lone undunte), you can apply to'n' number of transfers parallelly and each goes through its own path...right now your status is based on the pending petition, so mundu adhi approve avvaali...oka vela luck baaleka RFE fail ayyi H1B transfer reject aithe, you will automatically become out of status from the date you started working for the new company...u will need to leave country within 10 days to prove them that u left as soon as the decision came...alaa bayatikelthe u can again enter back without any issues applying for a new H1 transfer with the client through consular processing and attending the Visa stamping in India... | ||
