Why you, too, could get dragged off a plane if the airline overbooks your flight By Kari Paul Published: Apr 10, 2017 3:19 p.m. ET â€Your regular civil rights don’t apply when you’re on an airplane,’ according to consumer-rights group Just because you have a ticket doesn’t mean you’ll get on the plane. If you buy an airplane ticket, do you think the airline is allowed to make you give it up against your will — and even drag you off the plane? “Your regular civil rights don’t apply when you’re on an airplane,” said Paul Hudson of FlyersRights.org, a nonprofit airline consumer protection organization. “What you should do if you have a problem with a flight crew is to document it and file a complaint later. You have rights, but you have to exercise them once you’re off the flight.” Getting bumped from a flight is rarely convenient, but on Sunday it turned violent for one man aboard an overbooked United Airlines plane. Details about the incident and subsequent violent altercation are still emerging, but airlines are legally allowed to kick any passenger off a plane under the “contract of carriage.” The crew for the flight from Chicago to Louisville, Ky., was reportedly seeking four passengers to give up their seats and take another flight at 3 p.m. on Monday in exchange for a $400 travel voucher and a night at a hotel. When no passengers took the offer, United began to randomly select passengers including one who said he was a doctor and could not take a later flight. “After our team looked for volunteers, one customer refused to leave the aircraft voluntarily and law enforcement was asked to come to the gate,” United Airlines UAL, -0.73% said in a statement. “We apologize for the overbook situation.” Horrified passengers posted videos of the man being dragged from the plane on Sunday. A spokesman from the Chicago Police Department said that at 6:08 p.m. a 69-year-old male Asian airline passenger “became irate after he was asked to disembark a flight that was oversold.” “He began yelling, at which point aviation police were summoned,” the Chicago Police Department spokesman said. “The man fell and hit his head on an armrest as the police attempted to remove him from the flight. He was taken to Lutheran General Hospital for non-life threatening injuries.” The incident underscores the ongoing frustration consumers have with overbooking, in which airlines sell more tickets than there are seats on a plane in order to maximize profit. Customers who are “involuntarily denied boarding” of an aircraft on domestic flights (even if they’re already on the plane) are entitled to 200% of their one-way fare in compensation (no more than $675) in cash if their delay is more than one hour but less than two, according to a federal regulation. If the delay is more than two hours, they are entitled to 400% of a one-way fare (but no more than $1,350) in cash. ExpressJet Airlines had the highest rate of involuntary bumps per passengers at 1.58 per 10,000 passengers. United Airlines, by comparison, has a rate of 0.45 involuntary bumps per 10,000 passengers — that includes 47,199 voluntary bumps and 2,874 involuntary bumps. The policy causes headaches for consumers, but as Hudson at FlyersRights.org notes, it’s completely legal. â€Your regular civil rights don’t apply when you’re on an airplane.’ Paul Hudson, FlyersRights.org Indeed, airlines can kick passengers off for a number of reasons. According to the United Airlines Contract of Carriage, passengers can be removed from a flight for being overweight (if they are “unable to sit in a single seat with the seat belt properly secured”) or for smelling bad (”caus[ing] a malodorous condition”), or for being “not properly clothed.” These rulings are made at the discretion of the captain and crew, said Airfarewatchdog President George Hobica. “Passengers have far fewer â€rights’ than they imagine,” he said. However, involuntary bumping has been declining as airlines have gotten better at predicting flight capacity when overbooking, said Brett Snyder, author of the airline-industry blog CrankyFlier.com. More passengers are also taking the incentives for voluntary bumps, which is decreasing the number of forced denied boardings. One woman recently detailed how Delta airlines paid her $11,000 not to go to Florida on a trip. This included $1,300 per person in travel vouchers, a round trip taxi fare, dinner, and flights the next day. As long as customers are happy with these perks, overbooking is not likely to stop any time soon. And if it did, fares would start to go up. “Voluntary bumping is a good thing,” Snyder said. “The customer is happy because he’s agreed to take a voucher in exchange for a later flight. The airline is happy because it was able to overbook and generate more revenue.” Still, forced removals, despite their reward of up to $1,300 per flight, are not always worth it — as the man on the United flight whose removal ended in a trip to the hospital might say. “A lot of airlines are offering restricted vouchers and coupons that do not reflect the inconveniences and are far less than if you were involuntarily bumped,” Hudson said. Whether United broke any laws its Louisville flight Sunday, the incident is “historically bad public relations,” Hobica said — and comes as the airline is still recovering after coming under fire for not boarding several standby passengers, traveling on an airline pass, from a flight due to their clothing. “United could have easily avoided this historically bad public relations disaster had they increased the bumping compensation offer, either before boarding or once boarded,” he said. “Whatever it cost ... $1,000, $2,000, $3,000, would have been far cheaper than the cost to its reputation and the loss of business. You can be sure that passengers at least this week will choose any other airline to get where they’re going.” | ||
