Everyone is worried about India Travel, It is much more huge problem than Border Crossing. On Jan 25th EO was signed with 16 topics, of those 16 first one was terminate certain visas/AP's. Everyone panicked asking which AP did he cancel, then on Jan 27th, 7 Nations Visa's/AP's cancellation came into picture. Now lets look at remaining 15 points, out of those 15, H1B was mentioned 5 times directly or indirectly, L1/L2 mentioned about 6 times directly or indirectly, and B1/B2 was mentioned four times. Not a big deal if they mention so many times............ But here is the main problem, EO is involving DOJ and DOL. DOJ to report injury to American workers by H-1B, L-1, and B-1 employment. DOL perform increased "site visits"for L-1 work places. DOL plan to expand site visits for foreign worker work sites during the next two years. Untill now H1B's, B1/B2 and L1/L2 have been investigated by USCIS. now DOJ and DOL comes into picture. now you may think "No Big deal you think they got involved." just D's. In the past I was told some companies lied to USCIS, during the investigation USCIS found that companies lied, and USCIS fined the companies. Companies thought that it is just hardly slap on wrist. Companies also messed with DOL, DOL immediately placed the company under investigation and did not approve PERMS.(any recollection which company it is). If I'm correct it took close to two years to clear that investigation. Now if DOL finds similar issue as DOL did find in that past, company can be barred to perform any operations. Okay okay I got it, but not a big deal, since it will not impact me, it impacts only company. Not so fast....... Remember DOJ got involved.......... so how will it impact me. If DOJ finds any issue with Visa recipient guess what happens...........It can end up in Jail. In 2008/2009, there are few desi companies got screwed by state DOJ, but now federal DOJ is getting involved, so if you have to get your things straighten now is the time before it is too late. Again until we have clarity on remaining 15 Points, I will say everyone is at risk no matter where you are i.e. within the border or outside the border. below is 16 point EO, source http://www.immigration-law.com/XXIV.html Immediate Actions: Immediately terminate all the existing "parole" policies, gudance, and programs that contradict to this Executive Order policies. Review and start rule-making process to reform practical training and OPT programs. Review and start rule-making process to control work permits for B-1 and B-2 holders. Review and start rule-making process for E-2 investor nonimmigrant programs from the perspectives of its negative impact on American Workers Jobs. Review and start rule-making process for J-1 Summer Work Travel Program from the perspectives of its negative impact on American Workers Jobs. Within 30-Day Actions: Review and initiate rule-making process to reform of the current Visa Bulletin and visa allocation systems. Within 90-day Actions: Review and determine which regulations that give work permits to foreign workers negatively affect American workers or violate the law and initiate the rule-making process to repeal such rules. Review and determine which regulations that give parole to foreigners with work permits that affect American workers and initiate the rule-making process to repeal such parole program. Review and determine regulations from the perspectives of integrity of the program and restore such nonimmigrant worker programs. Determine reform of H-1B program to ensure the benefits to the best and brightest foreign workers. Initiate rule-making process for reform of H-2A program for efficiency and integrity. Reinforcement of E-verify program. DOJ to report injury to American workers by H-1B, L-1, and B-1 employment. Within 180-day Actions: DOL perform increased "site visits"for L-1 work places. DOL plan to expand site visits for foreign worker work sites during the next two years. Within 9 months Actions: DOL to come up with a plan to protect American workers from foreign workers in H-1B, L-1, and B-1 visas. | ||
