Non compete clauses are always signed, very strongly negotiated and argued but every lawyer knows that non competes are not enforceable in India as it goes against the fundamental right to employment. This has been upheld in many court judgements and you can ask your friend to hold his ground. In fact any company would be wasting its time and money on employee non competes. Cool babu cool

mee wadi vadhana.

I spend lot of my valuable time for this project. my mental and physical energy is spend on this. if they lost the project to smoother company , its not my fault. since i spent my time and energy on this it will be easy for me to continue. i cannot undergo one more training , i am comfortable working on this.

However, the Supreme Court of India has clarified that some non-compete clauses may be in interest of trade and commerce, and such clauses are not barred by Section 27 of the Contract Act, and therefore valid in India.[50] Notably, only those clauses backed by a clear objective that is considered to be in advantage of trade and commerce survives this test. For instance, a co-founder of a startup who signed a non-compete clause can be held to it,[51] but if a junior software developer or a call center employee signs a non-compete clause with the employer the same may not be enforceable.

other resources say the same too. unless you are at a shareholder level, i dont think you have to worry. ofcourse, consider about burning the bridge with the current company. you might not be able to get a job with them again, with same ease.

court lo .. brathakamantara savamantara ante saalu. u take for matching salary or leave him alone antaru.

but problem is , athanu sign chesina clause lo oka jurisdiction mention chesivuntundi. suppose if its delhi jurisdiction . he has to roam for delhi till case is settled. companies will have representatives everywhere. manaki problem.

companies file cases to irritate employees not to win.

Employye kotha Indian company lo cheri aa client ki work chesthunnadu.

Employee patha employer ki yeppudu non-compete cluase sign chesadu, directly or indirectly for one year I will not work for the client ani, daanni base chesukoni inko competitor dwara nuvvu adhe client ki pani cheyyadam modalettavyu ani legal case vese chance vundha? vunte nilusthundaa India lo?

Indhulo sadhaka badhakalu yenti?
