LOL Yes one of my friends have priority date in late 2008 didn't get GC during 2011-12 Now - they're still waiting for GC....hopefully by the end of this fiscal year they'll get it...if not sooner. | ||

What is meant by "Your date becomes current for Filing"? A date is announced in the VISA bulletin - then validated by USCIS a week/two later -- saying next month(1st to monthend) you can file 485 along with 485 - you can file EAD/AP petitions/applications. What is meant by "Your date becomes current for Final Action"? A date is announced in the VISA bulletin - saying next month (1st to monthend) there is a chance that your application gets pickedup for final adjudication - meaning you'll get GC, if your application gets picked for final processing and is approved. Here no one knows if your application gets picked up that month or not...all you know is there is a chance, your application is eligible to be picked up during that period. But during that same period -- if you leave the country - go back to India and get an appointment at US embassy/consulate -- your application gets picked for sure....and your chances of getting GC immediately are decent. | ||

When your date becomes current - if you go for consular processing - you'll get it immediately. Otherwise - you'll have EAD/AP. But actual GC, you'll be in Giant Wheel...no one knows. | ||

Fresh I-140 approval ante.. highly risky. Apparently, I-140 approval date nunchi 180 days cross ayyaka employer cannot do anything, they cannot revoke your GC process, so 180 days stay compulsory. As for I-140, your fresh H1-B Approval Notice will have the relevant I-140 Receipt Number on it. That is sufficient typically, unless Employer is willing to give I-140 Approval Notice to you also. Additionally, asalu I-797A which is H1-B Petition Approval Notice, employer should give you compulsorily. If they don't, then it is as good as slavery and exploitation. Now, coming to new FTE, you have to give I-140 Approval Notice, or atleast the I-140 Receipt Number in order to get 36 months on H1-B Transfer. As soon as you get your H1-B Transfered, and decide to move to new Payroll from new FTE, your old employer / consultancy can revoke your GC Process, because it is not yet 180 days. So, you have to start Perm Labor again from new employer, and you'll lose your old Perm Labor Petition Date / Priority Date. Ilaanti situation lo, I'll strictly look at the salary from FTE. Unless it is more than 25% of your last year's W2, it is not worth the risk at this moment. Wait for 180 days, and start looking for FTE later.
