you cannot work or get paid from the company even if you own the company. one way to get around that and explain that you did not get paid is saying or proving some one else is managing the company and it is a investment. if someone else is managing the company who hired the manager? if you hired him then you worked for your company even though you did not get paid for it. technically you are not supposed to do that. so if you own less than 50% of the company you are not actively managing the company , some one else has controlling interest so you are off the hook. | ||

Total badluck not from my end. I working as FTE from last 9 years. I filed original PD on 2008 but got denied in Nov 2010 due to some issue with my company with USCIS. lot of employees from my company files in 2008 PD got denied in 2010, total unfair. I worked on the great products and had good working experience in US. 1 patent approved and 2 patents on the way. | ||

Once you file I-485 - you will not pay any immi fees...in my attorney's words "Guys this is the last time you will pay any immigration fees. EAD/AP renewals are all free" And it obviously gives you flexibility to change jobs - but before moving you'll have to get the immi attorneys involved and come up with ways to show that your new job will be in same/similar professions. It's not easy. There was even some proposed rule (I don't know what happened to that) late last year on this topic....I heard it would make this same/similar a little bit, just a little bit easier. So it's not all that doom and gloom - it's ok to wait for EAD and hope for it.... | ||

My sincere suggestion: If you get a fulltime opportunity - and if you like the offer -- talk to them and see if they can start your PERM immediately. Negotiate on that. Then jump and get it out of the way ASAP. Of course, it is your decision. But just my 2 cents. | ||

Yes...when porting PD, you have no restrictions.... because for the new job/position you will go through PERM process... only after PERM gets approved when you file your new I-140 you will claim your old PD. That job positions, etc constraints/restrictions/issues come into picture after you file I-485 and invoke AC21 to change jobs. | ||

That is true. As I said earlier GC is about future employment. So - if company A files your PERM & I-140 -- and down the lane, if company A can't prove that they have the capacity to pay your wages in the future - they'll be forced to revoke your I-140. Again, in that case, I'm fairly certain that you can retain your PD. | ||

Nope. There is no time limit of any sort, that I know of. GC, by definition, is about future employment. So - technically speaking, the new employer can start your GC filing process, even before you join them | ||

As of today - unless your 140 is revoked for fraudulent reasons... You can retain your PD even if you change jobs...of course the new employer has to file PERM/140 for you There are very very very rare cases where USCIS won't let you use the previous PD, when you change jobs - so far according to what I read on murthy.com and other places, that is extremely rare and mostly in cases of fradulent situations. But usually - you can retain your PD. Again - this is based on my understanding of what I read. | ||

That's not entirely true. There are ways we can try...obviously we don't know what the result might be. IV and volunteers are trying their best to get HR213 introduced in the house.... people are making calls to various congressmen/women every day...some people are going and meeting their congressmen/women....to get them to cosponsor the bill. We all can do our bit...call our local congressman/woman and talk about it, get their cosponsorship for this bill - push them to introduce it for voting in the house, etc. This is the same bill that passed with 389Yes-15No votes in Nov 2011 (HR3012). At that time, due to whatever reasons the bill wasn't introduced in Senate. This time - the attempt is to have it passed in house before the end of this year and then look at Senate strategy. We can all give it a shot. The citizens here in the DB - like rocketk2 annai and others - if they also lend a hand to us, it'll be a great effort. | ||

What is your priority date? For the current month - if I remember correctly -- filing date states "anyone with PD prior to 01 Apr 2009" can file I-485. you can search google with "USCIS visa bulletin filing dates" and you can get the exact date. For Nov - the USCIS chart is not yet released | ||
