the issue here is not only judicial over-reach .. it is also about nominating shady characters as judges/protecting judges even after corruption allegations/total opaqueness on how sons/daughters/grandsons/relatives of prior judges get to be judges of Supreme/High courts .. if you consider all these .. Laloo yadav's son .. however horrible he may be .. will still have to get elected every 5 years (there is a chance that he may lose) .. where as .. corrupt judge Balakrishnan's son .. once appointed as judge will be there for decades! (btw .. his s-i-l contested for MLA from Cong when he was SC-CJ!) appointment of judges needs to be more transparent and the impeachment process should be more easy to remove judges who are corrupt .. i feel any unreasonable judgement actions on part of judiciary can be countered...hypothetically if the SC gives a judgement on fast a bridge should be built or a building inspector has to approve a file, doctor perform the maximum number of operations..... these can be argued and reasoned with the judge or bench....some Utopian judgments like RTE will also be brought to the ground sooner or later with enough emperical evidence.... political things like Muslim reservations by YSR must be brought by judiciary and thats were we are now | ||

I agree with vjavasi. Judicial overreach is not correct. They are not responsible to anybody. their self proclamation that they can auto correct themselves is pure joke. dont confuse emergency powers with the day to day judiciary respon.. president can still impose emergency when and if they please. constitution allows for that. no judge can stop that. by some account, nepotism is so high in these judicial appointments that > 50% of all these guys are sons, cousins, nephews of incumbents. | ||
