Not i140, it should be labor. Even i140 is revoked, the candidate carries the PD along with as long as the underlying labor is not revoked due to the fraud.. No matter how long later the new GC filing started, PD is stamped on his Yeas with hot burning metal seal. All he needs to do is turn around show that PD when filing the new GC i140 :-) | ||

my wife got lucky with this. she was at 9yr mark, and she wanted to take a break, quit the job and go on a trip to india for three months and once back wanted to look for a job. i have always been on FT althrough my career. its a dangerous situation to be in. 9 years lo survived around 6 or 7 rounds of layoffs or restructuring. but towards the end i was in the company for 11 years and would have gotten a severance of 7 months based on my contract. worst part was both my wife and I and worked in the same company. GC vachaaka wife moved on to contracting positions. that situation was safer from a status point. so both working ayithe, you can switch to H4 find another job and get on H1 again. | ||
