I talked to a senator (as I once attended a PAC through work) who served on immigration committes. He was very clear
For visas/GC's, these are their priorities
- Their diplomatic relations with their strategic countries
- No matter how good or bad, they want to spread the jobs/talent among as many countries as possible.
- Wherever applicable, ensure their own people doesnt lose jobs.
- People/immigrants who went to their schools
The above will supercede any of our concerns that we may think are realistic and make sense like below..
- I lived in this country for 10+ years and I need a GC
- Our spouses need work permits
- I am here legally by paying taxes etc
- We work by sacrificing our peak times by getting stuck in jobs/employers due to visa issues
Bottomline they want to contain visas and GC's. Restrict as much as they can. Becuase they know if not for this Indian there is an other Indian waiting to come here. |

My below prediction is valid only
If they start implementing this rule
Excluding dependent from primary quota
When I looked at my priority date after they
Implant above rule 50% time reduced
When EB3 backlog says 50K assuming that
Inclusive of dependents on backlog
If u exclude one person from backlog it comes to 25K primary
Per annum they are give hardly 1200 primary
Rest 1800 goes to dependents
If they would giving all 3000 to primary
I would be getting my GC in 6 years

Primary only so that many get their GC in reasonable
Time frame instead of waiting decades
If ppl get their GC in 2 or 3 years then no need of h4 or 140 EAD rules
3 years get their GC then at the max one time they have to go for stamping

Children born in the U.S. can sponsor their parents for green card status in the country. However, the child has to turn 21 to file an immigrant petition for his or her parents. At the same time, the childâs parents will need to meet all the requirements to get a green card in the U.S.
Nonimmigrants, who give birth to children in the U.S., believe that their children will immediately be able to sponsor them for permanent residence. But that is not true. Such nonimmigrant parents of U.S. born children will need to wait until their children turn 21 to get a chance to get green cards in the U.S. Until then, they must maintain their non-immigrant status. Falling out of status would prevent them from obtaining green cards in the U.S.
The term âanchor babyâ refers to a child born to undocumented immigrants in the U.S. Many illegally cross the border and get into the U.S. just to give birth to their children on U.S. soil, believing that they can get green cards through their U.S. born children. This is not true. U.S. citizens cannot file immigrant petitions for their undocumented parents. However, now that President Obama has announced his new immigration reform rule, undocumented parents of U.S. citizens and green card holders will be granted an opportunity to apply for legal status that will be valid for a three year period.
If children born on U.S. soil wish to sponsor their undocumented parents for legal status, their parents may be required to wait for more than 25 years. That is because, they must return to their home countries and remain there until they meet the requirements. Once they meet the requirements, their U.S. citizen children will be able to file immigrant petitions for them. After the petitions are approved and after they are issued immigrant visas, they may travel back to the U.S.
In some cases, undocumented parents of U.S. citizens may be allowed to apply for cancellation of removal, if they meet certain requirements. People held by immigration authorities for living here illegally can apply for cancellation of removal if the immigration authorities seek to deport them. In this case, they can apply for legal status without returning to their home countries, with the help of their childrensâ citizenship. |

Interesting...I was on the verge of going out of status (my project was over, no new project in sight) in the very recent past - because (almost) every position I apply for - they out rightly deny H1Bs. Luckily, by God's grace things fell in place in the last minute. Literally last few days.

Before I came to USA on H1B -- I knew that H1B process is difficult with rejection possible at every step - petition, visa, port of entry.
But as I stated in the first post - tons more restrictions were imposed in the last few years...this is making life a living hell.
But everytime I talk to my friends in India - who even may have an inclination towards H1B - I tell them these things to educate them. Later it is upto them. |
