Therefore, he can file a change of status from F-1 to H-1B now (i.e. in July 2014) even though the H-1B visas have run out. Note that he cannot start working until the change of status back to H-1B is approved so premium processing may be desired. This would also work for an individual who decided to change to H-4 status to take some time off (assuming of course that the individual’s spouse is also an H-1B worker). Example 2: Mr. Worker obtained an H-1B approval valid starting October 1, 2010. He worked for 3 years and then decided to return to his home country. He remained outside the U.S. for more than 1 year. Now he has a job offer in the U.S. Is he subject to the cap? No. Since he was already counted and only used three years of his H-1B, he is eligible for the remainder of his six-year limit. Therefore, he can file a petition for New Employment that is not subject to the cap and request consular processing now (i.e. in July 2014) even though the H-1B visas have run out. i need your information on the last date for an employer to file for below H1 case. This is very important situation for me. I worked on my H1B from Oct 2006 till May 2010. After that I moved out of US and didn't return due to family reasons and resigned my job in July 2010 (I was on payroll till July 2010). My last H1 B was valid till September 2010. I came back to US on F1 in 2014 and now I want to use the left over period on my H1B. My question is how much time do I have to apply for a new petition before the 6 year validity period expires.
