03/16/2016: USCIS Seeks OMB Approval for Binding Notice of "Determining Whether a New Job is in âthe Same or a Similar Occupational Classificationâ for Purposes of Section 204(j) Job Portability" On November 20, 2015, the USCIS released draft of non-binding memorandum for this revised policy seeking comment until 01/04/2016. Reactions to this draft was a mixed bag in the legal community even though the USCIS was allegedly redefinining this term to broaden the standard. After reviewing the comments, the USCIS finalized its draft again with an intent to publish it in the federal register upon approval of the OMB. The USCIS submitted its final draft to the OMB yesterday, 03/15/2016. It will be intersting to see whether the forthcoming notice will bring some more positive benefits for the immigrants in changing employment while they wait for green card approval. Obviously, the USCIS must have considered and intended to reconcile with another rule making process of "Modernization of Employment-based Immigration System."
