nothing to worry. maximum you may not get i94 in approval letter if uscis realize that it is revoked.

tomorrow if you file it it may get approved even before your previous company revoke it. act fast.

also to clear this all mess you can exit country and come back to make ur status clear. status issues are only in one visit. once you re enter your are clean again.. it is like taking bath in ganga.

1. You are allowed to be in the country until your I 94 expired. You are NOT out of status until then.


2. However, you can not work until you get your H1. You will be out of status only when you work without H1 or you stay after your I 94 expires.

Employer is required to notify DOL with 30 days of termination. You have 30 days from this notification date to file for new H1.

Kuyyo babai.. you can file a WRITTEN request to your current H1B employer to maintain your H1 status for an additional 30 days or so... so that you can find an alternative employer to file your H!B. Usually they would consider when they can legally do it.

Pay check end date enti? Is that for already completed pay period? If not you should be good. In other words, u should have transfer filed on or before your laid off date otherwise you are considered out of status and no use in filing transfer.

Your company has to withdraw your H1 and pay you a ticket to go to your home country. appati daka you are in status. ekkuva rojulu paycheck raka pothe it raises a flag anthe. so if you apply with in a reasonable time, you are okay. Nee tappu entho, nee company antha kanna pedda tappu chesinattu H1 cancel chesi ticket ivvaka poth. so usually you will get the luxury for fling H1.

Also after Ur h1 is filed make sure payroll is run every month until Ur h1 is approved

U still have to use Ur desi mestri job description if U want to retain Ur PD.. The company which is laying off used the same PD with similar roles and responsibilities aithe u have to use the old desi mestri roles and responsibilities..

If the tella company filed a new PD with new roles and responsibilities (which I doubt) u lost Ur PD because they will cancel the 140 is my assumption
