You are missing the point...if the issue is that big and that serious, why is no one approaching the courts, when there are so many opposition parties...the a priori conclusion people will draw, in the presence of such a weak and incompetent opposition, is that there is nothing wrong in what the govt is doing. Andhra Pradesh govt rejects RTI petition on MoU http://timesofindia.indiatimes.com/city/hyderabad/AP-rejects -RTI-query-on-capital-master-plan/articleshow/47209973.cms : In a development that has right to information (RTI) activists up in arms, the Andhra Pradesh government has refused to part with details of the memorandum of understanding (MoU) it signed with the Singapore government on preparing the master plan for the new capital of the residuary state. Replying to a query by an RTI activist, the municipal administration and urban development (MA&UD) department refused to furnish the details of the agreement, stating that "such information falls under the exemptions provided as per section 8 (1) of the RTI Act. Hence, the information cannot be provided." As per the RTI Act, there are 10 provisions under Section 8 (1) to which the state can take recourse to for withholding information. Some of the provisions are: If the information is sensitive to the sovereignty and security of the country; information forbidden for publication by any court of law or tribunal or the disclosure of which may constitute contempt of court; information of commercial confidence, trade secrets or intellectual property; the disclosure of which would harm the competitive position of a third party, etc. | ||

Another story of Rayapati Transstroy Transstroy â the infrastructure company belonging to Seemandhra MP Rayapati Sambashiva Rao and its Joint venture partner UES from Russia together bagged the Polavaram Dam contract recently. But latest news reports prove that this Joint venture has submitted forged documents to bag the Polavaram contract. The Transstroy â UES JV had submitted certain work experience documents to the Andhra Pradesh state government to claim eligibility to bid for the Polavaram dam project. As per the official procedure, these documents should be officially authenticated by the Chamber of Commerce and Industry of the Russian Federation and the Indian Embassy. AP state irrigation officials got doubt about the authenticity of these work experience documents after the CCI of Russia denied having authenticated any document pertaining to the UES. The Russian organization also stated the âexperience letterâ submitted to the state government under its letter-head was a forged one. AP state government is now caught in a terrible dilemma as it is about to enter into an agreement with the UES-Transstroy JV for Polavaram dam works. A senior AP irrigation engineer speaking to the media said âAs per tender conditions, the JV company should be blacklisted if it is found to have submitted forged documents. We cannot ignore these allegations as they came under the scrutiny of the AP High Court,â a senior irrigation official said. Apparently UES has claimed to have completed turnkey contract for works of a concrete gravity dam and Bureiskoe reservoir in Russia, which it had never done. | ||

The AP state government on Tuesday relaxed the agreement clause to benefit TD MP Rayapati Sambasiva Raoâs family-owned Transstroy India Limited, which is executing the Polavaram project. The company will now be paid Rs 200 crore as part of mobilisation in advance to addition to Rs 140 crore it already received. Though the agreement says machinery shall be bought under Joint Venture Company name of Transstroy India and Transstroy Russia, the machinery was bought only in the name of Transstroy India. The government relaxed the rule stating that the machinery worth Rs 340 crore is at the site and the same hypothecated to the project and invoices rose for the project. The principal secretary (irrigation) Adityanath Das said, âThe agreement has two contradicting clauses. One of the clauses say the machinery can be in the name of one of the partners of the JV Company. The other clause says the machinery has to be in the name of JV Company. So the company has applied to the government for relaxation and the government relaxed the clause agreeing with the applicant. The machinery invoice is in the name of company for Polavaram project and the machinery is stationed at the site.â He also added that the initial Rs 140 crore was paid earlier, as part of one per cent of total cost of Rs 4,000 crore, of the project. As per the rules five per cent of total cost can be given as part of mobilisation advance.
