another biggest point.. even you move out of your current employer and use ead for another job you are not safe.. if your employer on which your labor was approved is caught in any illigal activities then your 485 get rejected.. and you will be in water.. so always pray god that your old employer stays legal all the time. | ||

never heard such case before bro... but this is what I think is gonna happen... By not filing the AOS ur basically getting urself tied to the employer.. if u want to switch emp safe best is to file for labor etc and restart the GC process with new emp (still being on EAD)... enduku restart the process ante because ur not filing for AC21, if the old emp cancels 140 u will lose EAD and PD too... idi naa understanding but i might be wrong | ||

maharshi.. it is getting complicated.. h1, h4 , F1 is different.. Once you move on to EAD.. situation is different. h1 to h4 is easy.. becoz h4 is through husband h1. as long as husband h1 is valid .. wife can jump to h4 any time. in case of ead for wife also same situation.. she can come back to h4 as long as husband h1 is valid.. h1 is anchor for many things.. if h1 itself is void then you do not have anything to fall back if your 485 is rejected( as ead is void upon 485 rejection) | ||

jalsa. applying ead is not a problem. After getting , changing your status to ead is issue. If you change job and you give your ead as work authorization then you move to ead and loose your h1. You can have as many documents you want in usa, f1, h1, ead etc.. but you can have only one active at one time. It get activated only when you use it. so once you use ead you are on EAD status.... that is what you should nto do it. Keep ead for extreem situations like loosing h1b becoz of query etc. | ||

If u move on to EAD, of course ur revoking ur H1B and repu kharma khaali i-485 dobbithe u will have to leave the country.. (worst case scenario) For Changing the employer - Wait with current employer for 6 months then file for AC21 and join with new employer.. no labor, no porting etc etc is required - anthe kada?<<< sesani vuncle..per suppose u get EAD tomorrow..u wait for 6months..then jump to another employer..in such case nee H1b end ayipotundhi kadha?? unless new employer files H1b transfer, mostly they wont since u already have EAD..kaadha?? so to avail employer jumping facility which comes due to EAD, we will be forced to end H1b..anthena? in other words H1b will stay alive only until I stay with current employer or the new employer takes the extra step to file it? | ||

With the new process in place, my understanding is it will be same as regular GC process.. - Once the acceptance date is current (new PD date), we will file for I-485 (AOS),I-765 (EAD) and AP.. ippudu we will get the EAD and I-485 is pending until the date is current.... For Changing the employer - Wait with current employer for 6 months then file for AC21 and join with new employer.. no labor, no porting etc etc is required - anthe kada? - If u move on to EAD, of course ur revoking ur H1B and repu kharma khaali i-485 dobbithe u will have to leave the country.. (worst case scenario) Advantages - - You can work with any company using ur EAD. - You dnt need H1 renewals, amendments and no stamping.. - better billing rates for consulting Disadvantages - - EAD renewals every year (may not be a big deal) - Like mentioned before 485 pothe sarvam licked Bottom line is this is biscuit from uncle sam to pacify... deeni valla GC will take close to 15 yrs anedi clear ayyindi.. mee opinions/Points/comments add cheyyundri |
