Emi judement saamy TN High court nundi. A judge from Madras high court, S.Nagamuthu had delivered an interesting judgement on right to claim maintenance for women in case of a divorce. The judge said the women claiming alimony from her husband after the divorce should not indulge in sexual relationships with another man. The judge says women do not get alimony if the divorce is due to the extra martial relationship of the women and similarly the law would apply to divorce too. The judge opined that as a man carries an obligation to maintain his divorced wife, the woman also carries the obligation not to live in relationship with another man. So a divorced woman if indulged in a live in relationship, should claim the alimony from the new relation and not from her former husband. Needless to say this judgement had come under severe criticism from women welfare associations. |
