actual ga there was a wide spread criticism against the judgement those days. esp. in differentiating between "bribe givers and bribe takers". Later Govt asked to review it for a larger bench. But court dismissed it is too late to do so. anyway.. they(bribe takers) were acquitted for the clause 2 of Section 105.. which in no where applicable in this case "(2) No Member of Parliament shall be liable to any proceedings in any court in respect of anything said or any vote given by him in Parliament or any committee thereof, and no person shall be so liable in respect of the publication by or under the authority of either House of Parliament of any report, papers, votes or proceedings." clearly idi parliament lo voting ki sambandinchindi. or related to a speech. ante oka MP dabbulu teesukuni specific questions adigina, or MP money teesukuni oka party ki vote vesina (during no confidence or any other bill) daniki immunity undi ani but present case is no way related. Idi voter ni prolobhapettatam lantidi. nothing to do with the functions of member of a house. | ||

ACB court has lots of pending cases, I doubt if the judgement would be out before the assembly gets dissolved. So I don't think he will lose his post. The government may attempt to get him expelled by using the speaker and the majority MLAs but I doubt if it will stand. Also, if they do that, he won't be barred from recontesting so there is a good chance that he might win with a bigger majority and come back! After all, if a by-election is necessitated because of Revanth Reddy, Congress won't be in the scene and due to anti-establishment feeling as well as caste feeling, many Congress voters may vote for him. | ||

The favor sought in lieu of the bribe was a vote in the assembly by a member of that house. Legislative immunity varthistundi...technically SC judgment in JMM case can be used as a precedent. But that is unfortunate. I wish the SC had not gone by the letter of the constitution and instead gone by the spirit. Framers of the constitution did not give legislative immunity to allow the subversion of democracy in this way. It was given to allow them to freely and fairly attempt to work in public interest. Even if Revanth Reddy doesn't get immunity based on the JMM judgement, it wouldn't be easy to get him convicted. However, what he did is not appreciable. What PVNR did in JMM bribery is not a good-deed but I support it because it was the question of saving the government. Having the country's best interests at heart, if a PM tries to save his government, one must cut some slack in judging him by the means adopted (bribery in this case). In Revanth Reddy case, it was one bloody council seat and it is hard to imagine why that was important for the state! P.S: I strongly believe that TRS has lower ethical standards than TDP and they've done and are doing much worse. However, that doesn't justify this act of TDP/Revanth Reddy. | ||
