••••••• r right..if he has a valid H1. but once his old employer revokes his H1, he is out of status. if he didnt do it, he can still go back to his prev employer. but in this case, it seems that he did an extension to previous H1. and looks like his H1 ended as of Sep 30th. | ||

When was his last I-94 expiry date, the out of status days count start from the I-94 expiry date. Upto 180 days it is okay after that there will be a 3 year ban on his entry into the US. | ||

inni rojulu vundochu ane rule ledu..but enni rojulu vundakoodado ane rule vundi!! technically u r out of status from the day your H1B is denied. but ur petition MTR or whatever, as long as pending with USCIS, you can stay in US. but if its approved you are good. if not, you will be considered out of status from day 1. as long as it doesnt cross 180 days, you are good.(if the petition is pending) otherwise leave the country as early as possible. | ||

Bro theoretically he should be out of country by now. if he can leave the country with in 180 days from sep 30th he will not be susceptible to the 10 yr ban....so ask him to try to get another H-1 in next 2-3 months. The approved H-1 will not have I-94 so he will have to leave the country get stamped and then only enter to be legal again. He can stay but not advisable ...... if MTR is denied, he will be considered out of status since Sep 30, 2014. Even if he applies for another H1 from third company while MTR is pending and the third H1 is approved, he mostly will not get I94 extension and will have to go for stamping. | ||
