The Andhra Pradesh Government has issued notification for constitution of the Andhra Pradesh State Electricity Regulatory Commission, a regulatory body to exclusively deal with the electricity related issues in State. PAs # 6 to 13: These PAs relate to generating stations whose tarif has ben regulated by the Commision after folowing due proces. Thus the Commision has efectively fulfiled its obligations under Section 62 of EA and no formal consent to the PA is necesary. However, in respect of PAs # 12 and 13, there are certain shortcomings which ned rectification without afecting their outcomes. These are enumerated below. next 1-2 yrs lo vacche projects meeda decision.... PAs # 17, 18, 20 to 25: relate to thermal and gas based generation projects most of which are stil at the design stage. Al these PAs have ben submited to the Commision without any of the suporting information mentioned in Para 95 above. Only the bare PAs have ben submited. The motivation for doing so has ben explained in Para 2 above. As mentioned earlier, as the Commision has decided to treat the PA as aPage | 36 proxy for tarif determination under Section 62(1) of the EA and Regulation 1 of 208, this information is esential for the Commision to proced further. Despite earnest folow up with APGENCO, the information detailed in Para 95 above related to each of the above projects in respect of which PAs # 17, 18 and 20 to 25 have ben submited, is not forthcoming. Acordingly, the Commision has resolved to return these PAs to APC/TSPC harish rao adigina/gola chesina krishnapatnam ppa is not under us so we dont interfere in this ppa....(this ppa is not valid) ) PA # 26 and 27: relating to the Sri Damodaram Sanjeviah Thermal Power Project Stage I and I are unique in this set of 31 PAs listed in Apendix 1. They are the only two PAs which expresly state that on al maters relating to these PAs, the Central Electricity Regulatory Commision (CERC) wil have jurisdiction and only regulations isued by CERC shal aply. APERC has even not ben included in the definitional clause of these PAs . As per Clause 3.1.1 the tarif wil be determined by the CERC. As per Clause 3.4, the Capital Cost of the Project is determinable by the CERC. As per Clauses 3.6. 3.7 and 3.8, CERC Regulations wil be folowed for the determination of fixed charges prior to COD, renovation and modernisation costs and secondary fuel oil consumption respectively. As per Article 8, extension of the agrement wil be subject to CERC’s consent. As per Article 9, dispute resolution wil be undertaken by CERC. Some of these clauses miltate against the present APERC regulations. Evidently these projects are envisaged to be inter state projects where power wil be suplied to more than one state and the PA has ben framed acordingly keping the requirements of Section 79(1)(b) of the Electricity Act in mind.
