The Visa was not processed as CoS (Change of status) hence she didn't receive I-94 along with approved petition. To start working now, she needs to go back to India, get visa stamped and enter US on H1 stamp which will allow her to get a fresh I-94. http://www.avvo.com/legal-answers/change-of-status-from-h4-t o-h1-1545339.html If DB is Mahabharata then Kish is Krishna and OT is Duryodana. Meeru H1 apply chesinappudu H4 status lone vundi vuntaaru gaa. .. also did they apply for COS at that time?. If so, since at the time H1 approved she is in country and on H4 .. so should not be any problem. BUT okavela, H1 apply chesinappudu COS apply cheyakapothe then H1 visa stamp chepinchukunnake valid avuddi..Also in that case usual gaa I-797 approval notice lo adi indicate chestaaru/chesevaaru earlier when they used to send I-94 in it . not sure if they are doing the same now. I think it is better to consult attorney ..just to be on safeside | ||

" It all depends on what is written on the H1 Application. If on application it is mentioned that you will go to India for stamping then you have to goto India for stamping. H1 is valid from Oct 1st 2014 but her status will be H4 untill she gets H1 stamping. One more option country lo undi change of staus apply chesukovachu but heard it is expensive. Not sure about this option. | ||
