Happy path case: Timeline (No audit no RFEs): Optimisitic PERM: March 2014 PERM approved: (6-10 months): Aug to Dec 2014 I140: (premium): 4 weeks: Sep 2014 to Feb 2015 H1B Ext: (premium): 4 weeks: OCt 2014 to March 2015 H1 stamping: 2-4 weeks (depending on consulate): Nov 2014 to April 2015 Non happy path case: Pessimistic PERM process lo ekkadaina "Audit" padithey : Add 12 months from the date of audit to your case Make a note of this point here: Case lo audit padindhe anukundhaam kasepu, look at your PD, which say March 2014, say Sep 2014 lo Audit padindhi anukunna, it will add another 12 months.... which is Aug to Oct 2015 ... delaying the case by 12 or more months ... rest other timeframe remain as-is as mentioned in previous post.... Once you reach March 2015, which is 365 days from date of PD, you will be eligible to apply for H1b extension though your PERM is still in progress (be it delayed timelines, AUDIT or anyother reason)....this extension will only be for an year which is 7th year extension....precisely the boat you have missed owing to H1B maxout Above case is guddilo mella, we can still comeback with H1b extension, until I140 approval, though we apply we get only extension for year to year..... but still you will make into the country!!!! | ||

Idhi follow ayipooooooooooooooo.....naadhi assurance!!!! 1) PERM pending to approval process lo you don't need to be stationed in US (due to H1 max out or any reason) 2) I140 is followed above approval tharavatha 3) I140 approval tharavatha "non quota" lo H1 b extension apply chesthaaru 4) H1 b extension will be applied for 3 years by your company, direct employee aithey you will most likely get 3 years, layers aithey period taggacchu 5) H1 b approval copy tho visa stamping ki elthavu GC approval timeframe lo: (Transit) 1) In the entire above Steps 1 to 5 lo, you can work anywhere or be on a vacation or do nothing 2) You payroll can still continue post H1B maxout and you can still work remotely, reason being you are not binded to US immigration law anymore. This is legal and ethical. 3) With Step # 2 above, your employer should withhold SSN & Medicare taxes during this timeframe (until you are back on H1b extension). 4) Your employer should write to Social Security Administration with the needed information (your ssn, period outside stay, dates in & out, address etc)and get a certificate of compliance so that you are not taxed here for that period 5) With Step # 4, you should check for taxation in the country you will be working remotely or through a setup. 6. <country> should be be one of the countries that has Totalization agreement with United States that prevents double taxation. | ||

ok now I get ur question. Basically 5th year lo labor file chesi undali.... To get 1yr extension after 6th year. But you didn't file labor in ur 5th year. So now you need i140 approved to get 3yr extension. In that case, Switzerland ki poyi, labor, i140 approve ayyaka.. H1 extension kuda file chesi, approve ayyaka stamping ki poyi Kota H1 Meeda ravali. 10 days remaining tho vasthey little bit of risk, some officer with half knowledge can cause issue.
